07-09-20-4.4 - Resolution - 07/09/2020RESOLUTION NO. 07-09-20-4.4 A RESOLUTION TO AUTHORIZE THE BRAZOS COUNTY TAX OFFICE TO CALCULATE THE VOTER-APPROVAL TAX RATE IN THE MANNER PROVIDED FOR A SPECIAL TAXING UNIT AS THE CITY OF COLLEGE STATION IS LOCATED IN AN AREA DECLARED A DISASTER AREA PURSUANT TO SECTION 26.04(C-1) OF THE TEXAS TAX CODE. WHEREAS, the Governor of the State of Texas has declared a state of disaster in Brazos County pursuant to State law; and WHEREAS, the City of College Station has experienced a significant economic downturn caused by the global COVID-19 pandemic; and WHEREAS, Section 26.04(c-1) of the Texas Tax Code provides that the governing body of a taxing unit located in an area declared to be a disaster area by the Governor or by the president of the United States may direct the designated officer of the City to calculate the voter-approval tax rate in the manner provided for a special taxing unit (8 percent); and WHEREAS, the Brazos County Tax Office is the designated officer of the City; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: PART 1: That the facts and recitations set forth in this Resolution are declared true and correct. PART 2: That the City of College Station, Texas, hereby requests, in accordance with Section 26.04(c-1) of the Texas Tax Code, that the Brazos County Tax Office calculate the voter-approval tax rate for tax year 2020 in the manner provided for a special taxing unit (8 percent). PART 3: That this Resolution shall take effect immediately from and after its passage in accordance with the provisions of the Charter of the City of College Station, and it is accordingly so resolved. PART 4: That this Resolution shall become effective immediately upon adoption and shall stay in effect as set forth by applicable law. ADOPTED this 9th day of July, 2020.
