COUNTY OF BRAZOS )
That, G. KENNY MALLARD, JR. , AND JAMES H. BEHLING, GRANTORS , of
the County of Brazos, State of Texas, for and in consideration of
the payment of TEN and NO/100 DOLLARS , and other good and valu-
able consideration, in hand paid to GRANTORS by the CITY OF
COLLEGE STATION, TEXAS , the receipt of which is hereby acknowl-
edged, have GRANTED, SOLD and CONVEYED and by
these
GRANT, SELL, and CONVEY unto the said CITY OF COLLEGEresents STATION,3oa
Texas Municipal Corporation, certain rights and interests in the
nature of a perpetual EASEMENT on and through the following
described property:
Being a strip of land in the Thomas Caruthers Lea-
gue in Brazos County, Texas, fifty ( 50 ' ) feet in
width through that 75. 24 acre tract being the
remainder from that same 120. 398 acre tract con-
veyed to Menlo Properties by deed recorded in
Volume 567, Page 759 , of the Deed Records of Brazos
County, Texas.
Provided, however, that this conveyance shall

GRANTORS expressly subordinate all rights of surface use
to the mineral estate to the above described uses of said surface
by GRANTEE, incident
and agrees to lender' s subordinations on behalfof

It is expressly understood that the GRANTORS or
this property reserve the right future Owners of
purposes which do not interfereto use this EASEMENT for all
GRANTEE. with or prevent its use by the

TO HAVE AND TO HOLD the rights and interests herein described
unto the CITY OF COLLEGE STATION, TEXAS, and its successors and
assigns, forever, and GRANTORS do hereby bind themselves, their
heirs and assigns, to warrant and forever defend, all and
singular, these rights and interests unto the CITY OF COLLEGE
STATION, TEXAS, and its successors and assigns, against every
person whomsoever lawfully claiming, or to claim same, or any
part thereof.

21 JANUARY 1987
Being a strip of land in the Thomas Caruthers League in Brazos County,
Texas , fifty ( 50 ' ) feet in width through that 75 . 24 acre tract
conveyed to G. Kenny Mallard, Jr. by deed recorded in Volume 905, Page
554 of the Official Records of Brazos County,
twenty-five ( 25 ' ) feet each side of the following described
centerline:
Beginning in the northeast line of the said G . Kenny Mallard , Jr .
tract, at a point located S 76 degrees 31 ' 59" E - 150. 5 feet from the
most northerly corner of the said G . Kenny Mallard, Jr. tract , in the
southwest line of Rock Prairie Road.
Thence S 39 degrees 35 ' 08" E - 947. 1 feet , parallel to and 55 ' from
the centerline of the existing Gulf States Utilities Company
line, to the end of this easement in the southeast line of the said G.
Kenny Mallard, Jr. tract, at a point located S 41 degrees 56 ' 16" W -
647. 7 feet from the most easterly corner of the said G. Kenny Mallard ,
Jr. 75. 24 acre tract.
