KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF BRAZOS )
THAT, JOEL W. OWENS, individually, GRANTOR, of the County of
Brazos, State of Texas, for and in consideration of the Payment
of TEN and NO/100 DOLLARS, cash, and other good and valuable
consideration, in hand paid to GRANTOR by the CITY OF COLLEGE
STATION, TEXAS, the receipt of which is hereby acknowledged, has
GRANTED, SOLD and CONVEYED and by these presents does GRANT,
SELL, and CONVEY unto the said CITY OF COLLEGE STATION, a Texas
Municipal Corporation, certain rights and interests in the nature
of a perpetual EASEMENT on and through the following described
property:
Being all that certain ten foot wide easement,
lying and being situated in the Richard Carter
League, Abstract No. 8, College Station, Brazos
County, Texas, and being a portion of Lots 53 & 54 ,
College Hills Woodlands, an addition to the City of
College Station, Texas, as recorded in Volume 104 ,
Page 03, and being also a portion of a tract re-
ferred to as "Tract Two" in Volume 608 , Page 741 ,
both citations to the Official Records of Brazos
County, Texas.
Provided, however, that this conveyance shall

To erect, construct, install , and thereafter use, operate,
inspect, repair, maintain, reconstruct, modify, and remove the
following:
Electric transmission and distribution lines;
Water lines and sanitary sewer lines, connecting
lines, access facilities, and related equipment;
Storm sewers and collection facilities;
Television, telephone, and communications lines;
Drainage ditches, drainage pipes and all other
drainage structures, surface and subsurface;
upon, over, and across said property as herein described and any
ways, streets, roads, or alleys abutting same; and to cut, trim
and control the growth of trees and other vegetation on an
the easement area or on adjoining property of GRANTOR, c in
which
might interfere with or threaten the operation and maintenance of
any public utility equipment, accessories, or operations. It is
understood and agreed that any and all equipment and facilities
placed upon said propertyshall remain the property of GRANTEE.
GRANTOR expressly subordinates all rights of surface use incident
to the mineral estate to the above described uses of said surface
by GRANTEE, and agrees to sublender ' s subordinations on behalf
GRANTEE upon request.

It is expressly understood that the GRANTOR or future Owners of
this property reserve the right to use this EASEMENT for all
purposes which do not interfere with or prevent its use by the
GRANTEE.
TO HAVE AND TO HOLD the rights and interests herein described
unto the CITY OF COLLEGE STATION, TEXAS, and its successors and
assigns, forever, and GRANTOR does hereby bind himself, his
successors and assigns, to warrant and forever defend, all and
singular, these rights and interests unto the CITY OF COLLEGE
STATION, TEXAS, and its successors and assigns, against every
person whomsoever lawfully claiming , or to claim same, or any
part thereof.
This Correction Utility Easement is given in lieu of the correc-
tion of that one certain Utility Easement dated November 5, 1985,
and recorded on November 7 , 1985 , in Volume 838 , Page 708 , of the
Deed Records of Brazos County, Texas.

TEN FOOT WIDE UTILITY EASEMENT
LOTS 53 & 54
COLLEGE HILLS WOODLANDS
RICHARD CARTER LEAGUE, ABSTRACT NO. 8
COLLEGE STATION, BRAZOS COUNTY, TEXAS
Being all that certain ten foot wide easement, lying and being situated _
in the Richard Carter League, Abstract No. 8, College Station, Brazos County, -
Texas, and being a portion of Lots 53 & 54, College Hills Woodlands, an
addition to the City of College Station, Texas, as recorded in Volume 104,
Page 03, and being also a portion of a tract referred to as "Tract Two" in
Volume 608, Page 741 , both citations to the Official Records of Brazos
County, Texas, said easement being a strip of land ten feet in width, lying
southeast of, adjacent to, and running parallel with the following described
line: '
COMMENCING at the west corner of Lot 54, College Hills Woodlands, said
corner lying in the northeast right-of-way line of Marsteller Avenue;
THENCE in a northwesterly direction with said right-of-way line for a
distance of 3.2 feet, said line being also the southwest line of the
aforesaid "Tract Two", to the PLACE OF' BEGINNING;
THENCE N 32° E for a distance of 113.0 feet across Lot 53, said line
being also the northwest line of "Tract Two" to a point in the northeast
line of Lot 53, said point being the end of this line, and with the southeast
line of said easement commencing in the southwest line of Lot 54 and
terminating in the northeast line of Lot 53.
