Revised to include grantee's address (art. 6626, RCS) 1-1-82. 1,:C5 DEC I 0 rt i `: 12 WARRANTY DEED (LONG FORM) THE STATE OF TEXAS 949a- KNOW ALL MEN BY THESE PRESENT COUNTY OF BRAZOS That MELFRED DOYLE ROBERTSON and wife, BETTY JO ROBERTSON, GRANTORS of the County of Brazos and State of Texas for and in consideration of the sum of TEN AND NO/100 ($10 . 00) 'DOLLARS and other valuable consideration to the undersigned paid by the grantee herein named, the receipt of which is hereby acknowledged, have GRANTED, SOLD AND CONVEYED, and by these presents do GRANT, SELL AND CONVEY the CITY OF COLLEGE STATION, a Texas municipal corporation, unto of the County of Brazos and State of Texas the following described real property in Brazos all of County, Texas, to-wit: All that certain tract or parcel of land lying and being situated in the Morgan Rector League in College Station, Brazos County, Texas, being a part of Lot 4 of Lake View Acres, an addition to the City of College Station, Texas, according to plat of record in Volume 128, Page 300 of the Deed Records of Brazos County, Texas, and being a part of that tract conveyed to Melfred Robertson by deed recorded in Volume 418, Page 642 of the Deed Records of Brazos County, Texas, and being more particular described as follows : i 31 65-3 S'3 VOL S4SPAGE 57 P BEGINNING at an iron pipe found in the northwest line of Miller' s Lane at the most southerly corner of the said Melfred Robertson tract which is also the most easterly corner of that tract conveyed to Anton Slafka by deed recorded in Volume 268, Page 37 of the Deed Records of Brazos County, Texas. THENCE N 48° 44 ' 47" W - 14.38 feet along the line between the said Slafka tract and the said Robertson tract to a point for corner; THENCE N 43° 04 ' 05" E - 87.99 feet through the said Robertson tract to an iron rod set for corner in the line between said Robertson tract and that 29 . 366 acre tract conveyed to James A. Ford by deed recorded in Volume 276, Page 774 of the Deed Records of Brazos County, Texas. THENCE S 48° 44 ' 20" E - 15.07 feet along the line between the said Robertson tract and the said Ford tract to the most easterly corner of the said Robertson tract in the northwest line of Miller' s Lane; ' THENCE S 43 ° 31 ' 02" W - 88. 01 feet along the northwest line of Miller' s Lane to the Point of Beginning and containing 1 ,295 square feet of land more or less. SAVE AND EXCEPT, and there is hereby reserved unto GRANTORS, their heirs, executors, and administrators, all of the oil , gas and other minerals in and under and that may be produced from the above property; provided that there shall never in any event be any ingress or egress on or across the surface of the above described premises for the purposes of exploration, development, production or transportation of such oil , gas or other minerals; it being expressly contemplated by the parties to this instrument that any production of such minerals shall be from the surface of other adjacent property. GRANTORS shall have the right of ingress and egress at all times only for the purpose of accessing adja- cent property for the development of said lands for oil , gas and other minerals and removing the same therefrom. of any minerals that would require mining, There shall be no development haft miningning, or any other kind of mining that would requresutilization, oflt thelsurface. GRANTORS may pool such mineral interests for development with adjacent parcels. GRANTORS do not reserve and expressly convey to GRANTEE any and all minerals of whatsoever kind and nature down to the depth of two hundred fifty feet ( 250 ' ) from the actual surface of said tract.
