HomeMy WebLinkAbout1984V695P38 302172 UTILITY EASEMENT (Specific Property) STATE OF TEXAS * ' F.:: 2: 3 KNOW ALL MEN BY THES I� 'SEI�T'LS: COUNTY OF .$RAZOS * 'V ; THAT, TEXAS INSTRUMENTS, INC. , of the County of Brazos, State of Texas, GRANTOR, for and in consideration of the payment of TEN AND NO/100 DOLLARS, cash, and other good and valuable consideration, in hand paid to GRANTOR by the CITY OF COLLEGE STATION, TEXAS, the receipt of which is hereby acknowledged, HAS GRANTED, SOLD, and CONVEYED and by these presents does GRANT, SELL, and CONVEY unto the said CITY OF COLLEGE STATION, a Texas Municipal Corporation, certain rights and interests in the nature of a perpetual EASEMENT on and through the following described property: Being a strip of land twenty feet ( 20 ' ) wide for a construction easement situated in the J.W. Scott League, Abstract No. 49, and the Richard Carter League, Abstract No. 8, in Brazos County, Texas, and being out of a 250.0 acre tract conveyed to Texas Instruments, Inc. , by deed recorded in Volume 424, Page 672, of the Deed Records of Brazos County, Texas, said strip of land being contiguous to, and the southeast line of said construction easement being coincident with, the northwesterly line of an existing twenty foot ( 20 ' ) wide permanent utility easement located along and parallel with the southeast line of said 250 .0 acre tract, same line being the northwest line of State Highway 30, said construction easement being granted for one ( 1) year from the date hereon. Provided however, that this conveyance shall grant the rights herein specified only as to that portion of the above described property more particular) centerline on the y described by course, width, and cent attached Exhibit "A" , known as the "Easement and any additional area outside the easement area necessary to install and attach all equipment and facilities, including guy lines and anchors, necessary and incident to the uses of the Easement Area. To erect, construct, install, inspect, repair, maintain and thereafter use, operate, reconstruct, modify, and remove the Water lines and sanitary sewer lines, lines, access facilities, and related equipment n upon, over, an, across said wys, stree , roods property as herein 'described and any and control the growth,of trees abutting same; and to cut, trim the easement area or on adjoinin and other vegetation on and in might interfere with or threaten thepoperation and maintenance p y of GRANTOR, which of any public utility equipment, accessories or operations . is understood and agreed that any and all equipmentqIt is placed upon said property and facilities shall remain the property of GRANTEE. TRACT CONSTRUCTION EASEMENT Being a strip of land 20 feet wide for a construction easement situated in the J.W. Scott League, Abstract No. 49, and the Richard Carter League, Abstract No. 8, in Brazos County, Texas, and being out of a 250.0 acre tract conveyed to Texas Instruments, Inc. by deed recorded in Volume 424, Page 672 of the Deed Records of Brazos County, Texas, said strip of land being contiguous to, and the southeast line of said construction easement being coincident with the northwesterly line of an existing 20-foot wide permanent utility easement located along and parallel with the southeast line of said 250.0 acre tract, same being the northwest line of State Highway 30, said construction easement being more fully described as follows: Commencing at an iron pin for the most easterly corner of said 250.0 acre tract in said northwest right-of-way line of State Highway 30; same point being on the common line between the Texas Instruments 250.0 acre tract and the Carrara Corporation 113.67 acre tract as recorded in Volume 476, Page 782 of the Deed Records of Brazos County, Texas; THENCE, in a northwesterly direction along the aforesaid common property line of the Carrara tract and the Texas Instruments tract, a distance of 20 feet to a point, said point being on the extension of the northwesterly line of above said 20 foot permanent easement, same point being the PLACE OF BEGINNING for the hereinafter described 20-foot construction easement. THENCE, in a southwesterly direction along the northwesterly line of said 20-foot permanent easement, same line being 20 feet from and parallel with the northwesterly line of State Highway 30, a distance of 3524 feet, more or less, to a point, said distance including a curve paralleling the centerline of the 120 foot right-of-way of State Highway 30, said highway centerline curve data given, as follows: D = 8° 49' ; D = 2° 00' ; T = 220.8' ; L = 440.8' ; . E = 16.9' said point being in the southwesterly line of said Texas Instruments 250.0 acre tract, same point being 20 feet from the most southerly .corner of said tract; THENCE in a northwesterly direction along the southwesterly line of the Texas Instruments tract, a distance of 20 feet to a point; said point also being 40 feet from the northwesterly •right-of-way line of State Highway 30; THENCE in a northeasterly direction 20 feet from and parallel with the northwesterly line of said 20-foot permanent easement, including curve as described above, a distance of 3529 feet, more or less, to a point being in the common line of the Carrara tract and the Texas Instruments tract; THENCE in a southeasterly direction along said common property line, a distance of 20 feet to the POINT OF BEGINNING.
