HomeMy WebLinkAbout1983V602P519 I _L) 276655 Bel) UTILITY EASEMENT SEP 12 1983 (Specific Property) RANK ' M # sy 1111 STATE OF TEXAS KNOW ALL MEN BY THESE PRESENTS: COUNTY OF BRAZOS * THAT, WOODCREEK JOINT VENTURE, GRANTOR, a Texas Partnership, of the County of Brazos, State of Texas, for and in consideration of the payment of TEN AND NO/100 DOLLARS, cash, and other good and valuable consideration, in hand paid to GRANTOR by the City of College Station, Texas, the receipt of which is hereby acknowledged, HAS GRANTED, SOLD, AND CONVEYED and by these presents does GRANT, SELL, and CONVEY unto the said City of College Station, a Texas Municipal Corporation certain rights and interests in the nature of an EASEMENT on and through the following described property: Being situated in the Thomas Caruthers Survey, Abstract 9, in Brazos County, Texas, and being a portion of a 26.07 acre tract conveyed to Cornerstone Investment Group by deeds recorded in Volume 491, Page 229 of the Deed Records of Brazos County, Texas and being a portion of an 88.16 acre tract conveyed to Cornerstone Investment Group by deeds recorded in Volume 469, Page 426 of the Deed Records of Brazos County, Texas. Provided however, that this conveyance shall grant the rights herein specified only as to that portion of the above described property more particularly described by course, width, and centerline on the attached Exhibit "A" , known as the "Easement Area" , and any additional area outside the easement area necessary to install and attach anchors and guy lines or wires. To erect, construct, install, and thereafter use, operate, inspect, repair, maintain, reconstruct, modify, and remove the following: , e/ G' vOl 2 AGE X519 / Underground electric transmission and distribution lines Sanitary sewer lines, connecting lines, access facilities, and related equipment for the construction and operation of a major "trunk line" sanitary sewer. Storm sewers and collection facilities Television, telephone, and communications lines upon, over, and across said property as herein described and any ways, streets, roads, or alleys abutting same; and to cut, trim and control the growth of trees and other vegetation on and in the easement area or on adjoining property of Grantor, which might interfere with or threaten the operation and maintenance of any public utility equipment, accessories, or operations . It is understood and agreed that any and all equipment and facilities placed upon said property shall remain the property of Grantee. TO HAVE AND TO HOLD the rights and interests herein described unto the CITY OF COLLEGE STATION, TEXAS, and its succesors and assigns forever, and GRANTOR DOES hereby bind itself, its successors and assigns to warrant and forever defend, all and singular, these rights and interests unto the CITY OF COLLEGE STATION, TEXAS, and its successors and assigns, against every person whomsoever lawfully claiming, or the claim same, or any part thereof. A 26.07 acre tract conveyed to Cornerstone Investment Group by deeds recorded in Volume 491, Page 229 of the Deed Records of Brazos County, Texas; 2. A 88.16 acre tract conveyed to Cornerstone Investment Group by deeds recorded in Volume 469, Page 426 of the Deed Records of Brazos County, Texas; The centerline of said 20 foot wide easement being more fully described as follows: BEGINNING at the north corner of the aforementioned 26.07 acre tract, said corner being located on the common league line between the aforementioned Thomas Caruthers Survey, Abstract 9 and the Morgan Rector League, Abstract 46; said corner lying in the southwest line of a 79.00 acre tract of land conveyed to Cornerstone Investment Group by Raintree Development Joint Venture by deed recorded in Volume 469, Page 697 of the Deed Records of Brazos County, Texas; THENCE South 12° 05' 28" West, a distance of 44.87 feet more or less to .the POINT OF BEGINNING; said POINT OF BEGINNING also being the end of a 20 foot sanitary sewer line easement conveyed to the City of College Station by easement recorded in Volume 518, Page 239 of the Deed Records of Brazos County, Texas; THENCE South 45° 56' 00" West, a distance of 276.67 feet more or less, to a point; THENCE South 11° 49' 11" West, a distance of 355.88 feet more or less, to a point; THENCE South 66° 49' 11" West, a distance of 85.69 feet more or less, to a point; THENCE South 36° 31' 26" West, a distance of 105.04 feet more or less, to a point; THENCE South 22° 25' 04" East, a distance of 144.81 feet more or less, to a point; THENCE South 07° 00' 31" West, a distance of 202.08 feet more or less, to a point.;' THENCE South 28° 45 ' 46" West, a distance of 389.48 feet more or less, to a point; THENCE South 19° 53' 04" East, a distance of 348.05 feet more or less, to a point; THENCE South 28° 10' 26" West, a distance of 717.35 feet more or less, to a point; THENCE South 45° 58' 41" 'West, a distance of 775.18 feet more or less, to a point; said point lying on the State Highway 6 northeastern right-of-way line; said point also being northwest 10 feet more or less from an iron pin in the south corner of said 88.16 acre tract. Save and except all portions of this centerline description that are located within the Woodcreek Drive right-of-way. An additional easement for construction purposes is granted for a period of one (1) year from the date hereon, said construction easement being a 50 foot wide strip of land. The centerline of said construction easement shall follow the centerline of said 20 foot wide easement through the first seven described calls; Thence the centerline of said construction easement shall be parallel with and 15 feet west of the centerline of said 20 foot wide easement through the remaining calls.
