GRIFFIN, GRANTORS, of the County of Brazos, State of Texas, for and in consideration of the payment of TEN AND NO/100 DOLLARS, cash, and other valuable consideration, good and in hand paid to GRANTORS by the City of College Station, Texas, the receipt of which is hereby acknowledged, HAVE GRANTED, SOLD, AND CONVEYED and by these presents do GRANT, SELL, and CONVEY unto the said City of College Station, a Texas Municipal Corporation certain rights and interests in the natu r of an EASEMENT on and through the following described re property: Being a 24.18 acre tract, situated in the Robert Stevenson League, Abstract 54, in Brazos County, Bob J. Griffin, recorded in Volume 220, Pages686CofvthedDeeto d Records of Brazos County, Texas . Provided however, that this conveyance shall grant the rights herein specified only as to that portion of the above described property more particularly described by course, width, and centerline on the attached Exhibit "A", known as the "Easement Area", and any additional area outside the easement area necessary to install and attach anchors and guy lines or wires . To erect, construct, install, and thereafter use, vp82cte, inspect, repair, maintain, reconstruct, modify, and remove the following: Underground public utilities, including water, sewer, 589 101 -1- VOL PAGE ; r ,� urantor in locating or relocating such incidental surface facilities . upon, over, and across said property as herein described and any ways, streets, roads, or alleys abutting same; and to cut, trim and control the growth of trees and other vegetation on and in the easement area or on adjoining property of Grantor, which might interfere with or threaten the operation and maintenance of any public utility equipment, accessories, or operations . It is understood and agreed that any and all equipment, poles, and facilities placed upon said property shall remain the property of Grantee. Grantors expressly subordinate all rights of surface use incident to the mineral estate to the uses of said surface by Grantee. TO HAVE AND TO HOLD the rights and interests herein described unto the CITY OF COLLEGE STATION, TEXAS, and its succesors and assigns forever, and GRANTORS DO hereby bind themselfes, their heirs and assigns to warrant and forever defend, all and singular, these rights and interests unto the CITY OF COLLEGE STATION, TEXAS, and its successors and assigns, against every person whomsoever lawfully claiming, or the claim same, or any part thereof. A PARCEL 16 EXHIBIT "A" Being a strip of land 20 feet wide for a permanent public utility easement situated in the Robert Stevenson League, Abstract 54, Brazos County, Texas, in that 24. 18 acre tract and in that 11.965 acre tract conveyed to Bob J. Griffin by deeds recorded in Volume 220, Page 686 and in Volume 240, Page 77, respectively, of the Deed Records of Brazos County, Texas, and being more particularly described as follows : BEGIN at the north corner of said 24.18 acre tract, said corner being the intersection of the existing southwestern right-of-way line of State Highway 6 with the southeastern right-of-way line of Graham Road, (a County Road) ; Thence Southwest, 203 feet along the southeastern right-of-way line of Graham Road to the POINT OF BEGINNING of this DESCRIPTION; THENCE S 32° 14' 22" E, 6.34 feet to a point in the future west right- of-way of State Highway 6 ; THENCE along a line coincident with the future west right-of-way of State Highway 6 to a point in the common property line between said 11.965 acre tract and a tract of land conveyed to Joseph S. Osoba and wife, Mildred L. Osoba, by deed recorded in Volume 313, Page 346 of the Deed Records of Brazos County, Texas , the following: S 82° 25' 12" E, 71.6 feet S 35° 05' 16" E, 200.2 feet S 32° 13' 31" E, 400.0 feet S 27° 56' 11" E, 200.6 feet S 32° 13' 29", E, 534.3 feet S 38° 33' 19" E-, 406.2 feet aforesaid point also being southwest 122 feet from an iron pin in the existing west right-of-way of State Highway 6 and being the common eastern corners between said Griffin and Osoba tracts; THENCE Southwest, 20 feet along the common property line between said Griffin and Osoba tracts to a point; THENCE along a line parallel with and 20 feet west of the aforesaid future west right-of-way of State Highway 6 to an angle point the following: N 38° 33' 19" W, 408.6 feet N 32° 13' 29" W, 535.9 feet N 27° 56' 11" W, 200.6 feet N 32° 13' 31" W, 398.8 feet N 35° 05' 16" W, 190.9 feet N 82° 25' 12" W, 72.2 feet 5 8 I.
