OF PUBLIC EASEMENT

STATE OF TEXAS KNOW ALL MEN BY THESE PRESENTS
COUNTY OF BRAZOS
THAT THE CJTY OF COLLEGE STATION, a home rule municipal corporation , does
hereby release and abandon that one certain easement or right-of-way for
described as follows, said easement being within the City limits of the '
City of College Station and subject to the sole ownership and control of
the City on behalf of the public; said easement being declared unnecessary
and abandoned by the City Councfl by Ordinance 1354 , passed and
approved on MARCH 95, 19 82 •

A 10 foot wide strip on the north side of the 20 ft.
utility easement on the south-east side of Lot 3,
Block 4, of Phase I and running the length of the lot.

And the City does hereby release and surrender
•
the portion of utility easement described above
in its corporate capacity and on behalf of the public, forever.
EXECUTED this 26 day of MARCH 19 82 , by authority of the ordinance
cited herein.

PUBLIC UTILITY EASEMENT IN PHASE I , BLOCK 4 , LOT 3 ,
EMERALD FOREST ADDITION TO THE
CITY OF COLLEGE STATION, TEXAS .

Utility Easement No. Date: March 8 , 1982
TO THE MAYOR AND CITY COUNCIL OF THE CITY OF COLLEGE STATION:
The undersigned hereby made application for the vacation and abandon-
ment of that portion of the public utility easement situated in the
above named addition, and particularly described in Exhibit No. 1,
attached. In support of this application, the undersigned represent
and warrant the following:
1. The undersigned will hold the City of College Station
harmless, and indemnify it against all suits, costs,
expenses, and damages that may arise or grow out of

such vacation and abandonment;
2 . Attached, marked Exhibit No. 2 , is a plat or sketch'
of that portion of the public utility easement sought
to be vacated and the surrounding area to the nearest
streets in all directions, showing the abutting lots
and block, and the addition in which the above
described portion of such utility easement is situated,
together with the record owners of such lots;
3 . Attached, marked Exhibit No. 3 , is the consent of
public utilities to such vacation;
4 . Attached, marked Exhibit No. 4 , is the consent to such
vacation of all the abutting property owners, except

5 . Such public utility easement should he vacated
because:
• The easement in question is 20 feet in width and
is all inside one lot which restricts the building
space of this lot . The 10 ft . which is being
requested to be abandoned and move to an adjacent
lot , does not have any utilities in the area.
6 Such public utility easement has been and is being
used as follows:
The area requested to be abandoned does not contain
any utility services and is not being used.

to use, under the terms and provisions of our respective franchises
with the City of College Station, that portion of the public utility
easement sought to be vacated in the Application to Vacate Utility

The undersigned, City Engineer for the City of College Station,
certify that I have carefully considered the Application to Vacate
Utility Easement above referred to from the standpoint of present and
future needs of the City of College Station with respect to traffic
and city utilities, and I see no objection to the requested vacation
from the City' s standpoint.
