KNOW ALL MEN BY THESE PRESENTS
COUNTY OF BRAZOS
That I , JOHN C . CULPEPPER, JR. , of Brazos County , Texas ,
for and in consideration of the sum of ONE DOLLAR ($ 1 . 00) cash ,
and other good and valuable consideration , to me in hand paid
by the CITY OF COLLEGE STATION , College Station , Texas , the
receipt and sufficiency of which is hereby acknowledged , do
hereby sell , give and grant unto the said CITY OF COLLEGE
STATION , a municipal corporation , of Brazos County , Texas , a
utility easement , described as follows :
Being a part of a 10 . 762 acre tract or parcel of land
lying and being situated in the Richard Carter League ,
College Station , Brazos County , Texas and being part of
Block "B" of Culpepper Plaza Addition to the City of College
Station as shown on the plat of the said addition recorded
in Volume 278 , Page 39 of the Deed Records of Brazos County ,
Texas , and being more particularly described as follows :
BEGINNING at the intersection of the southeast right-
of-way line of Dominik Drive with the northeast right-of-
way line of State Highway No . 6said intersection located
S 46° 52 . 4 ' E along the said northeast right-of-way line
of State Highway No . 6 a distance of 301 . 07 feet from the
rock marking the west corner of the beforementioned Culpepper
Plaza Addition ;
THENCE S 46° 52 . 4 ' E along the beforementioned northeast
right-of-way line of State Highway No . 6 , same being the
southwest line of the beforementioned Block "B" at a distance
of 150 feet past a concrete monument marking the southwest
corner of a 94 , 125 square foot tract out of said Block "B"
conveyed to the Holiday Inn , continue along the said northeast
right-of-way line , same being the southwest line of the
said Holiday Inn Tract for a total distance of 400 feet to
a concrete monument for the PLACE OF BEGINNING of this
utility easement , same being the southeast corner of the
said Holiday Inn tract ;
THENCE S 46° 52 . 4 ' E . along the abovementioned northeast
right-of-way line of State Highway No . 6 , same being the
southwest line of the abovementioned Block "B" for a distance
of 15 . 0 feet to a point for corner ;
`THENCE N 43° 07 . 6 ' E across the abovementioned Block
"B" for a distance of 386 . 5 feet to a point for corner ;
THENCE N 46° 52 . 4 ' W for a distance of 15 . 0 feet to a
point for corner ;

THENCE S 43° 07 . 6 ' W for a distance of 10 . 0 feet to
a concrete monument , said concrete monument marking the
northeast corner of the abovementioned Holiday Inn Tract ;

THENCE S 43° 07 . 6 ' W along the southeast line of the
abovementioned Holiday Inn Tract for a distance of 376 . 50
feet to the PLACE OF BEGINNING containing 0 . 133 acres of
land more or less .
TO NAVE AND TO HOLD the above property unto the CITY OF
COLLEGE STATION for the purposes aforesaid and maintaining any
and all utilities placed therein ; provided that Grantee will ,
after doing any work in connection with the construction ,
reconstruction , re-locating or maintenance of said utilities ,
restore the surface to the condition to which said surface was
found when such work was undertaken ; and that in the use of said
rights and privileges herein granted the CITY OF COLLEGE STATION
will not create a nuisance or do any act that will be detrimental
to said premises .
Grantor does hereby bind himself , his heirs , executors and
administrators , to warrant and forever defend , all and singular ,
said premises unto the CITY OF COLLEGE STATION against every
person whomsoever lawfully claiming or to claim the same or any
part thereof .
