Know all men by these presents, that I, Robert J. Smith
of the County of Harris , State of Texas , for and in consideration of
the sum of one ($1. 00) dollar to me cash in hand paid by the City of College Station, Texas,
a municipal corporation in Brazos County, Texas, duly incorporated under the general
laws of the State of Texas, the receipt of which is hereby acknowledged, a granted, sold,
and conveyed, and by these presents do grant, sell and convey unto the said City of College
Station, Texas, certain rights and Interests in the form of an EASEMENT on and through
the following descry.):: nrrparty.-.
Lying and being situated in the Crawford Burnett League in Brazos, County, Texas,
and being a 20 foot wide utility and drainage easement approximately 900 feet in
length lying in and through the 17.03 acre tract conveyed to Robert J. Smith by
Area Progress Corporation by deed recorded in Vol. 280, page 58 of the deed records
of Brazos County, Texas and said easement being centered along the line described
as follows:
Beginning at a point in the Southwest Boundary line of said R. J. Smith tract,
which point is N. 57 46' 11 " E, a distance of 323 feet from the South Corner of the
tract,
Thence in a Northwesterly direction through the said tract to a point in the
Northwest Boundary line of the tract, said point being S. 45° 50" W, a distance of
426 feet from the North corner of said tract. •
Thence along the Northwest Boundary line of said tract, N. 45° 50" E, a distance
of 426 feet to the North corner of the tract being a point in the S.W. Boundary
line .of Welch Blvd. at end of easement.
The easement herein granted extends outward at 90° from the centerline a
distance of 25 Beet and 10 feet in width at such places as required for guy lines
for utility poles, all as shown on the plat on the reverse side hereof.
To have and to hold the rights and interests herein before described unto the
said City of College Station, Texas, and its successors and assigns forever and I do hereby
bind myself, my heirs, executors and administrators, to warrant and forever defend, all
and singular these rights and Interests unto the said City of College Station, Texas, and its
successors and assigns, against every person whomsoever lawfully claiming, or to claim
the same, or any part thereof.
