The Board of Directors of The Texas A&M University System, hereinafter called Board, acting herein by and through the President of the System, pursuant to authority of Chapter 228, Acts of the 54th Legislature, 1955, the President being authorized further by Minute Order No. 257-67, a reproduction of which is attached as Exhibit A, in consideration of mutual benefits to be derived by the respective parties, and subject to existing easements of record and conditions recited herein, hereby grants to the City of College Station, Texas, an easement for utilities on and across the land in Brazos County described by metes and bounds in Exhibit B and shown on the plat in Exhibit C attached and made a part hereof. 2. The easement herein granted is for the purpose of permitting the City of College Station to construct power, water, and sewer facilities in the area shown in Exhibit C; provided, however, that said facilities shall be placed within ten (10) feet of the cemetery line so as to leave the major part of the right-of-way free for University use in the future. It is provided, also, that should the facilities constructed on the easement herein granted be in the way of any future construction proposed or sponsored by Texas A&M University, they will be removed without cost to the University. 3. The grantee is granted the right of ingress and egress to and from said easement for the purpose of constructing, erecting, maintaining, repairing, replacing, and rebuilding said facilities and such is not granted for any other purpose. The grantee agrees to occupy the land only to the extent and for the length of time necessary when constructing, erecting, ",,r/e maintaining, repairing, replacing, and rebuilding said facilities. 3-6 4.
