KNOW ALL MEN BY THESE PRESENTS:

That X, We, Cherokee Limited. a limited partnership
of the County of
Bexar, State of Texas, for and in the consideration of the sum of $1.00 ,
and the further consideration of the enhancement of the value of the land,
paid by and moving from the City of College Station, a Municipal Corporation
of Brazos County, Texas, the receipt of which is hereby acknowledged, have
granted, bargained, and conveyed, and by these presents do grant, bargain,
and convey unto the City of College Station, its successors and assigns, a
right-of-way easement for the purpose of constructing and maintaining a
Sanitary Sewer Line
of said City, across a certain tract of land situated in Brazos County, Texas,
described as follows:
Being all that certain 14.58 acre tract or parcel of land, lying and being
situated in the Crawford Burnett Leaaue, Abstract No. 7, in Brazos County.
Texas, and being the same 14.58 acre tract conveyed to Cherokee Limited. by

Said right-of-way easement being more particularly described as follows:
Bein• a stri. of land twent (20) feet in width and 1 in. ad acent to
and southwest of the following described line:
BEGINNING at the most southerly corner of the aforementioned 14.58 acre
tract, said corner also lying on the northeast right-of-way line of the old
Missouri-Pacific Railroad right-of-way (abandoned) ;
THENCE N 60°44'24" E for a distance of 483.09 feet to a point for the /c L/6
PLACE OF BEGINNING of said easement;f tj . (Pc /l.J '1
THENCE N 31°17'12" W for a distance of 28.54 feet to an angle point;•
THENCE S 68°44'28" W for a distance of 126.74 feet to an angle point;
THENCE N 51°57'10" W for a distance of 398.65 feet to an angle point;
THENCE S 71°25'20" W for a distance of 123.87 feet to a point for the
end of said easement, said point lying on the southwest property line of the
aforementioned 14.58 acre tract, said property line also being the northeast
right-of-way line of the aforementioned railroad right-of-way.
There shall also be granted a temporary construction easement twenty

five (25) feet in width and lying adjacent to the said 20 foot permanent

easement, said construction easement shall become null and void upon com-

It is specifically understood that the City of College Station and .
its assigns shall be granted free ingress, egress, and regress to and from
said strip of land for the purpose of making improvements on, and repairs
to the aforesaid, as shall be necessary and convenient at all times.
TO HAVE AND TO HOLD unto the said City of College Station, Texas, a
Municipal Corporation as aforesaid, for the purposes aforesaid, the promises
above described.
