MEMBERS PRESENT' Mayor Pro--Tem Halter; Councilmen Ringer, Boughton, Dozier, Hazen, Adams; City Manager Bardell; Student Liaison DuBois; Director of Public Works Ford; City Engineer Ash; City Planner Mayo; City Attorney Lewis; Director of Parks and Recreation Beachy; Fire Chief Landua; Chief of Police Byrd MEMBERS ABSENT' Mayor Bravenec VISITORS PRESENT- See guest register _Agenda Item No. 1 -- Approval of minutes of previous meetings. The minutes were approved as read. Agenda Item No. 2-- Hear visitors. No one spoke. Agenda Item No. 3-- Presentation of p!__aque t.O Mr. Jack Lester. Mayor Pro-Tem Halter presented a plaque to Mr. Jack Lester, Sr. for his recent donation of $10,000 for a pool dome at Bee Creek Park. Agenda Item No. 4 -- A .public hearing on the question of rezoning Lots 4 and 5, Block C of the College Heights Addition from Duplex District R-2 to General Commercial District C-1. Agen..d.a It. em. No. 5-- Cons_ideration of..a_n ordinance rezoning the above tract. Councilman Dozier moved to rezone the area from R-2 to A-P. Councilman Hazen seconded the motion. Vergil Stover, chairman of the Planning and Zoning Commission, stated that the lot size could not adequately handle the requested C-1 zoning. The motion to approve Ordinance No. 1133 passed by the following vote' FOR---Councilmen Ringer, Boughton, Dozier, Halter, Hazen AGAINST --- Councilman Adams Councilman Adams based his vote on the premise that he believed the property should be zoned C-1 as requested. Agenda Item No. 6 -- A public hearing on the question of a~lopting an ordinance amending the Zoning 'O~rdin~nce _.ap it pertains to the section concerning Planned Unit Developments. MINUTES, Regular City Council Meeting October 26, 1978 7:00 P.M. Page 2 City Planner Mayo presented the proposed amendment to Ordinance No. 850. The public hearing was opened. No one spoke and Mayor Pro-Tem Halter closed the hearing. Agenda Item No. 7 -- Consideration of an ordinance amending the Zoning. Ordinance as it pertains to Planned Unit Development. s. Councilman Dozier moved to pass Ordinance No. 1134 amending Ordinance 850 as proposed by the staff. Councilman Hazen seconded the motion. Councilman Dozier questioned the possibility of industrial use in the city's PUD. The motion to approve Ordinance No. 1134 passed unanimously. Agenda Item No. 8 -- A public hearing on the question of adopting an ordinance amending the Zoning Ordinance No. 850 to define how to "use" a Conditional Use Permit and providing ~ ren~ewa~ procedure. City Planner Mayo explained the problem with the existing time limit in Ordinance 850 and presented an amendment to alleviate this situation. The public hearing was opened. When no one spoke, it was closed. Agenda Item No. 9 -- Consideration of an ordinance amending the Zoning Ordinance to define how to "use" a Conditional Use Permit and providing a renewal procedure. Councilman Dozier moved to adopt Ordinance No. 1135 amending the Zoning Ordinance. Councilman Boughton seconded the motion. Councilman Adams asked about the time limit required for a building permit. The motion passed unanimously. Agenda !t_e_m_ N0. 10-,_ Dis.cussion of screens on windows as required by Ordinance No. 1128. City Manager Bardell reminded the Council of previous discussion on the matter. Mr. Chuck Harty questioned why the ordinance was retroactive on units already in existence. He presented figures for adding screens to existing windows. Mr. Rob Chastain presented an idea of student installation of apartment owner purchased screens. Ms. Paula Waggoner questioned the Council concerning the law being retroactive. She was told that the ordinance is not retroactive. Page 3 Agenda Item No. 11 -- Presentation of prelimin, ary de. sign on fire substation by Tim Keneipp. Mr. Tim Keneipp, project architect, presented his proposed design for the fire substation. Agenda Item No. 12 -- Mr. John Garner to address Council. Mr. John Garner, 701 Thomas, stated that he had conveyed a piece of property to a neighbor, yet had not altered the lot. _Agenda Item No. 13-- Consideration of bids on cover for Adamson Pool. Director of Parks & Recreation Beachy presented the bids received and answered questions of the Council. Councilman Ringer moved to table consideration of the bids until the next regular meeting. Councilman Boughton seconded the motion to table. Councilman Ringer noted that the extra time would allow the staff to consider the matter further. The motion passed unanimously, Councilman Dozier being absent. Agenda Item No.;_ 14 -- Consideration of bids on trucks. Public Works Director Ford presented the bids and recommended the following' The bid for two 1/2 ton pickup trucks be awarded to Lawrence Marshall for $11,463.92. The bid for one 1/2 ton pickup truck be rebid, due to exceptions to published specifications. The bid for two garbage trucks and bodies be awarded to Twin City International for the trucks for $31,595.20 and to Davis Truck & Equipment for the bodies for $22,320.00 Councilman Ringer moved to award the bid for two 1/2 ton trucks to Lawrence Marshall for the sum of $11,463.92. Councilman Bougthon seconded the motion which passed unanimously. Councilman Dozier moved to rebid the one 1/2 ton truck. Councilman Ringer seconded the motion which passed unanimously. Councilman Ringer moved to award the bid for the garbage trucks to Twin City International for the trucks and to Davis Truck and Equipment for the bodies. Councilman Dozier seconded the motion which passed unanimously. Agenda Item No. 15 -- Consideration of bids on police patrol cars. Chief Byrd presented the bids received and recommended the acceptance of the low bid of Beal Ford for six patrol cars, total bid including trade-ins $34,464.00. Councilman Dozier moved acceptance of the recommendation. Councilman Ringer seconded the motion which passed unanimously. MINUTES, Regular City Council Meeting October 26, 19 78 7:00 P.M. '-' The plat passed by consent. .Agenda Item No. 19--Closed session to consider personnel. The Council convened into closed session. Agenda Item No. 20 -- Appointmentpf- Parks Board member, all members of the Structrual Standards Board, member of the Ut'ili~y'' Rat~ 'Study Committee. The Council came back into open session and announced the following appointments- Councilman Hazen moved that Dee Springer be added as a member of the Parks Board, subject to her acceptance. Councilman Dozier seconded the motion which passed unanimously. Councilman Dozier moved that Tim Coppinger be appointed a member of the Structural Standards Board. Councilman Hazen moved to add Joseph Williams to the Structrual Standards Board. Councilman Ringer seconded the motions which passed unanimously. Councilman Ringer moved to add Roy Hann as a member of the Utility Rate Study Committee. Councilman Adams seconded the motion. The motion passed by the following vote- FOR--- Councilmen Ringer, Boughton, Adams AGAINST--- None ABSTAINING--- Councilmen Hazen, Dozier, Halter Agenda Item No. 21 -- Council Concerns. Councilman Halter asked about acquiring right-of-way from Mrs. Marion Pugh at the Varsity II Apartments. MINUTES, Regular City Council Meeting October 26, 1978 7:00 P.M.
