MEMBERS PRESENT: Mayor Bravenec; Councilmen Ringer, Gardner, Dozier, Halter, Stephenson, Hazen; City Manager Bardell; Director of Public Works Ford; City Planner Mayo; City Engineer Ash; Planning Assistant Longley MEMB ERS AB SENT: None Agenda Item No. 1 -- Consideration of ward system (at request of interested citizens). Mr. D. A. Anderson presented the Council with a petition signed by over 700 citizens asking that the Council reconsider the outcome of the recent charter revision election. Mr. Anderson requested that legal action be taken and that a straw vote be conducted. Mr. Clinton Robison read a statement against the ward system. Mrs. Fumi Sugihara questioned the legality of the straw vote. Mr. James Harris asked for clarification of the alternative types of ward systems. Councilman Gardner asked what legal action would be taken if the straw vote indicated that a majority of those voting did not favor the ward system. Mayor Bravenec replied that legal action would have to be taken to upset the election. Mrs. Janet Natowitz asked if it would be possible to contact all persons who voted in the April 3, 1976 election and determine if they had voted as they intended. Mayor Bravenec stated that if the straw vote indicated sentiment against the ward system, this could be a possible step in the resulting law suit. Mrs. Sugihara asked how the results of the straw vote would be interpreted if the turnout was lower than in the general election. Mayor Bravenec stated that the smaller the vote, the less conclusive the results would be and that there would be no way to recreate the first election. Councilman Stephenson moved that the City Council cause to be taken whatever action is appropriate and necessary to protect the City's position pertaining to the 30 day deadline regarding final acceptance of the outcome of the April 3, 1976 vote dealing with the proposition to divide the City into wards for election of future councilmen. Additionally, it is directed that action be initiated to conduct a straw vote as soon as practical to determine voter sentiment on this issue. If at least 55% of the voters participating in the straw vote indicate they favor retention of the present at large method of electing councilmen, then it is directed that whatever action is necessary and appropriate be taken to invalidate the April 3, 1976 vote pertaining to the revision of the City Charter. The motion was seconded by Councilman Halter and approved with Councilman Gardner voting against and Councilmen Dozier and Ringer absent. Mayor Bravenec suggested that another meeting be held to discuss the general obligation bonds portion of the Capital Improvements Program. The Council set a special meeting for 2:00 P.M. Monday, May 3, 1976, to discuss the general obligation bonds.
