MEMBERS PRESENT- Mayor Bravenec; Councilmen Gardner, Hazen, Stephenson, Ringer, Dozier, Halter; City Manager Bardell; City Planner Mayo; Planning Assistant Longley; Administrative Secretary Moss MEMBERS ABSENT- None VISITORS PRESENT' See guest register, Agenda Item No. 1 -- Consideration of tabled Ordinance No. 1013 rezoning certain tracts of land in the Crawford Burnett Leagu~e' .fro..m Single Family Residential District R-1 to Apartmen~t Building District R-3 and Neighborhood Commercial District C-N as specified. The request being in the name of Mohawk, LTD. Councilman Hazen moved that Ordinance No. 1013 be removed from the table. The motion was seconded by Councilman Halter and approved with Councilman Gardner voting against. Mr. Edsel Jones, representative of Mohawk, LTD. made a presentation to the Council in support of the proposed rezoning. Mr. Jones stated that his organization's intent in the proposed apartment development was to serve the developing West Campus area. Councilman Halter asked what it would cost the City to extend sewer to the proposed project. Mr. Jones replied that there would be no cost to the City as the project could be sewered into the line serving Treehouse. Mr. Jones stated that his organization was willing to pay for the extension of utilities to future developments in this area but that they were asking for zoning only on the land that was needed at the present time. Mr. Jones stated that the proposed 100 units would provide $6,600 annually in tax revenue to the City and $19,000 to the school district. Councilman Halter pointed out the need to improve Luther Street in the area of the apartment project. Mr. Jones stated that his organization had agreed to improve Luther in front of the apartment project, and that they had approached the University to gain a righty-of-way to connect Luther Street and Jersey Street in order to gain additional access. Councilman Halter questioned access to the site by fire vehicles. Mr. Jones stated that this was indeed a problem and that this was a major reason for trying to get another access. Mr. Jones proposed that this rezoning would accommodate 100 units and that no additional units be permitted until the additional access could be obtained and other conditions met. Mr. Jones pointed out that the location of the proposed apartments ~~~~ed MINUTES, Special City Council Meeting April 16, 1976 Page 2 an attempt to separate apartments from single family residences. Councilman Gardner stated that construction of the proposed apartments would tend to preclude industrial development in the area. Councilman Gardner also stated that there was no assurance of gaining an additional access, and that the limitation of access by fire vehicles plus the dangerous railroad crossing at Luther Street would have to be major considerations. Councilman Gardner presented maps indicating areas of zoned but undeveloped C-1 and R-3 land where apartment development would be possible. Mr. Jones agreed that there was a lot of apartment zoned land but that his main consideration in choosing the proposed location was the close proximity to the University and the West Campus. Councilman Dozier pointed out that besides zoning, an apartment project needed a willing developer and financing. Councilman Dozier stated that, in his opinion, this was a good location for apartments. Councilman Dozier suggested that it be made a condition of the rezoning that the railroad crossing at Luther Street be adequately signalized. Dr. Chris Mathewson of the Planning and Zoning Commission spoke relating the considerations of the Commission in the proposed rezoning. Mr. Jeff Dunn, President of the Texas A&M Student Body, spoke in support of the proposed rezoning and apartment development. Councilman Hazen asked if the apartments could be designed so as to provide front and rear access and egress for added fire protection. Mr. Jones stated that the units would be designed to minimize fire hazards. Mr. Mark Snyder of Student Government stated that he was in favor of the construction of more apartment units. Councilman Halter moved that Ordinance No. 1013 be adopted provided the following conditions' 1. That the railroad crossing at Luther Street be signalized with a type of system to be approved by the City; the cost of which will be transferred to the developer. 2. That a. 100 foot right-of-way be obtained by the developer from the West Bypass to Luther Street along the abandoned railroad right-of-way. 3. That a right-of-way be granted by the University from Jersey Street to Luther Street and that the developers pay for the improvement of this street. 4. That no certificate of occupancy be granted until the above conditions are met. The motion was seconded by Councilman Stephenson and approved unanimously with Councilman Gardner not present.
