HomeMy WebLinkAbout03/22/1971 - Regular Minutes - City Council MINUTES REGULAR CITY COUNCIL MEETING CITY OF COLLEGE STATION, TEXAS March 22, 1971 7:00 p.m. Members Present: Mayor Pro-tem C. H. Ransdell; Councilmen James H. Dozier Bill J. Cooley, Joseph J. McGraw, Cecil B. Ryan, Dan R. Davis; City Manager Ran Boswell Members Absent: Mayor D. A. Anderson Visitors Present: See Guest Register Mayor Pro-tem Ransdell called the meeting to order at 7:00 p.m. in the Council Room of the City Hall. Mrs. Hensarling's government class was recognized as being among the visitors. On motion by Councilman Ryan, seconded by Councilman McGraw, the minutes of Council Meetings of February 22, 1971, March 1, 1971, and March 9, 1971 were approved. There was a discussion concerning an ordinance prohibiting the sale of non-returnable containers in the City of College Station. A group from the audience exhibited several large size plastic bags filled with bottles and cans collected on one side of Highway 30 from the Spin-in grocery to the East By-pass, a distance of one mile. On motion by Councilman McGraw, seconded by Councilman Dozier, the ordinance was tabled. The motion carried with Councilman Ryan voting "no". On motion by Councilman Dozier, seconded by Councilman McGraw, it was recommended to the mayor that a committee be appointed to study methods for creating an awareness among the citizens concerning ecology, and also, that provisions be made to place litter barrels in the community. The motion carried. Mayor Pro-tern Ransdell asked for concurrence of the Council, which was given, in officially excusing Mayor D. A. Anderson from the Council meeting. Mayor Pro-tem Ransdell recognized Mrs. Clara Sandstedt, Chairman of the Beautification Committee, who is in charge of the clean-up campaign on April 3. She said that response from everyone whose help she has enlisted in the campaign has been very good. She passed out bumper stickers to call attention to the date of the campaign and stressed the fact that this is a free pick-up. On motion by Councilman Ryan, seconded by Councilman McGraw, Ordinance No. 728, an ordinance calling for a public hearing on the question of rezoning P&Z Case #/_,-71, P&Z Case #5-71, P&Z Case #6-71, P&Z Case #7-71 and P&Z Case #9-71, was passed and approved. Minutes of Council Meeting March 22, 1971 Page 2 On motion by Councilman Davis, seconded by Councilman Ryan, Ordinance No. 729, an ordinance to amend Ordinance No. 690, changing time of submission of final plats from 10 to 14 days as recommended by the Planning and Zoning Commission, was passed and approved. On motion by Councilman Dozier, seconded by Co~ancilman McGraw, Ordinance No. 730, an ordinance providing for a public hearing to consider the adoption of an amendment of Ordinance No. 38 to include a Planned Unit Development (P-U-D), was passed and approved with the provision that the portions of the FHA bulletins mentioned therein, which apply, be made a part of the ordinance. On motion by Councilman Ryan, seconded by Councilman McGraw, Ordinance No. 731, an ordinance accepting the work of improving portions of Nimitz Street and Marstel'ler Avenue, was passed and approved. Councilman Dozier moved that the Council accept the bid of Young Bros. with the alternate of black base as recommended by Lloyd James, City Engineer. It was seconded by Councilman McGraw. Motion carried. On motion by Councilman McGraw, seconded by Councilman Dozier, Ordinance No. 732, an ordinance determining to assess a part of the cost of improving portions of Burt Street, Suffolk Avenue, Patricia Street, Spruce Street, Luther Street, and Montclair Avenue against abutting property and the owners thereof, was passed and approved. On motion by Councilman Davis, seconded by Councilman McGraw, Ordinance No. 733, an ordinance ordering construction of sidewalks on Francis Drive from Shady Drive to Francis Drive dead-end, and authorizing engineer to prepare plans and specifications therefor, was passed and approved. On motion by Councilman Ryan, seconded by Councilman Davis, April 7 at 5:~5 p.m. was set as the date for canvassing election returns and for the induction into office of those who are elected in the April 6, ~971 election in accordance with Article IX, Section 98 and Article III, Section 31 of the City Charter. Councilman Dozier brought to the Council's attention that the City had received a statement for expenses for the law suit handled for the City by Baker & Botts, Attorneys at Law, of Houston, Texas. He stressed the fact that these were expenses incurred by the firm while representing the City, not individual councilmen. On motion by Councilman Dozier, seconded by Councilman McGraw, a resolution is to be drawn up directing the City Manager to make payment on April 15, 1971, thereby allowing time for any taxpayers who may wish to file suit to prepare and file their petition. Motion carried with Councilman Cooley voting "no".
