11-10-83-14
WHEREAS, the City of College Station having determined the
necessity of extending municipal water transmission lines
south of the City along Texas Highway 6 to the eventual site
of a new elevated water storage tank at Greens Prairie Road
and Texas Highway 6, the extension of a parallel electric
feeder line for new customers within the newly annexed area
of the City, and for other public utilities as the need for
same shall arise in the future; and
WHEREAS, the City Council having determined that it is
necessary to obtain the easements described on the attached
Exhibits A and B to this resolution, and that the public
need requires the acquisition of same in such a manner as to
make the property available for lawful use for such
purposes;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of College Station that the easement areas described on
Exhibits A and B attached hereto shall be acquired by the
City; and the reasonable cash market value of same shall be
determined and paid according to law, either by voluntary
purchase or by condemnation; and that the City Manager, the
Mayor, and the City Attorney are authorized to take any and
all necessary actions to obtain and pay for such property,
including the marketable title thereto, free and clear of
any restrictions or covenants inconsistent with the use of
same for all lawful public utility purposes. Further, that
the City Attorney is by this resolution expressly authorized
to initiate and pursue condemnation proceedings and any
other necessary litigation incident to the purpose herein
set forth.

EXHIBIT "A"
Being a strip of land 15 feet wide for a permanent public utility
easement situated in the Robert Stevenson League, Abstract 54, in
Brazos County, Texas, in a 5 acre tract conveyed to Patrick Farrell
and wife, Margu~ette Farrell, in Volume 383, Page 223 of the Deed
Records of Brazos County, Texas, and being more particularly
described as follows:
BEGIN at an iron pin in the existing west right-of-way line of State
Highway 6, said iron pin also being the common eastern corners of
said Farrell tract and a 10 acre tract conveyed to Carl W. Matthews
and wife, Elaine K. Matthews, in Volume 531, Page 384 of the Deed
Records of Brazos County, Texas; Thence Southwest, 109 feet to the
POINT OF BEGINNING of this DESCRIPTION;
THENCE S 49° 24' 36" E, 307.8 feet along a line coincident with the
future west right-of-way line of State Highway 6 to a point in the
common property line between said Farrell tract and a 30 acre tract
conveyed to Dwayne L. Rhea and wife, Jewel T. Rhea, in Volume 421,
Page 234 of the Deed Records of Brazos County, Texas, said point also
being southwest 109 feet from an iron pin in the existing west right-
of-way line of State Highway 6 and being the common eastern corners
between said Farrell and Rhea tracts;
THENCE Southwest, 15 feet along the common property line between
said Farrell and Rhea tracts to a point;
THENCE N 49° 24' 36" W, 307.8 feet along the line parallel with and
15 feet west of the aforesaid future west Cight-ofLway line of State
Highway 6 to a point in the co...on property line between said Farrell
and Matthews tracts;
THENCE Northeast, ~5. feet along the con,non property line between
said Rhea and Matthews tracts to the POINT OF BEGINNING and the end
of this DESCRIPTION.
An additional easement for construction purposes is granted for one
(1) year from the date hereon, said construction easement being a
50-foot wide strip of land whose western boundary is coincident with
the western boundary of the aforesaid permanent easement.

Being a strip of land in the Robert Stevenson League in Brazos
County, Texas, twenty (20') feet in width through that 5.0 acre
tract conveyed to Patrick ~arrell by deed recorded in Volume 383,
Page 223. of the Deed Records of Brazos County, Texas, and lying
ten (10') feet each side of the following described ceDterline:
Beginning in the northwest line of the said Farrell tract which
is also the southeast line of t~a~ 20 acre tract conveyed to Carl
W. Matthews by deeds recorded in Volume 531, Page 381 and Volume
531, Page 384 of the Deed Records of Brazos County, Texas, at a
point located S 40 degrees 59' 52" W - 104.18 feet from an iron
stake found marking the common corner of the said Matthews 20
acre tract and the said Farrell 5.0 acre tract in the southwest
line of State Highway No. 6.
Thence S 49 degrees 25' 37" E - 307.94 feet to the end of this
easement in the southeast line of the said ~arrell 5 acre tract
which is the northwest line of that 15 acre tract conveyed to
Dwayne D. Rhea by deed recorded in Volume 421, Page 234 of the
Deed Records of Brazos County, Tex~s, at a point located S 40
degrees 59' 52" W - 103.60 feet from an iron stake found marking
the common corner of the said Rhea 15 acre tract and the said
Farrell 5 acre tract in the southwest line o~ State Highway No.
6.
