:AS, the City of College Station has determined the
necessity for acquisition of property on Foster Street for
the extension and expansion of the existing City Hall
building and facilities, including necessary parking area;
and
WHEREAS, the City Staff has contacted Dr. an Mrs. Stephen W.
Seager, the fee title owners to a lot and the improvements
thereon located at 1210 Foster Street in College Staton,
Texas, and is seeking to negotiate an agreement to purchase
said lot and the improvements thereon.
NOW, THEREFORE, BE IT hereby resolved by the City Council of
the City of College Station that the property described
below shall be acquired by the City by voluntary cash
purchase or by condemnation from Dr. and Mrs. Stephen W.
Seager for the cash market value of same, not to exceed a
disinterested appraisal of same.
Said property being Lot 11, Block 9, College
Hills Estates, Second Installment, an addition to
the City of College Station, Texas, as shown by
the plat recorded in Volume 99, Page 156, of the
Deed Records of Brazos County, Texas
and the transfer and expenditure of funds for

IT IS FURTHER RESOLVED that the City Manager and City
Attorney are authorized to take whatever acts are necessary
and appropriate on behalf of the City to accomplish said
transaction, and to obtain marketable title to said property
including the right to use same for the above purposes,
together with the improvements located thereon and described
herein, and to obtain title insurance assuring the
marketable title to said property.
This resolution shall authorize the initiation of
condemnation proceedings where necessary to obtain said
property or remove any restrictions on the use of same which
are inconsistent with the public purpose for which the
property is to be acquired, and appeal from any award which
is deemed to be excessive in the opinion of the City
Attorney.
