WHEREAS, the City of College Station has determined the
necessity for acquisition of property in Sandstone Addition
for the purpose of constructing, operating and maintaining
neighborhood park facilities, a fire substation on the
northwest corner one-half of Lot 29, and other municipal
uses related thereto.
WHEREAS, the City Staff has contacted Wick A. McKean,
the fee title owner to a lot and the improvements thereon
being Lot Number 19, Sandstone Addition, College Station,
Texas, and is seeking to negotiate an agreement to purchase
said lot and the improvements thereon.
NOW, THEREFORE, BE IT hereby resolved by the City
Council of the City of College Station that the property
described below shall be acquired by the City by voluntary
cash purchase or by condemnation from Wick A. McKean for the
cash market value of same, not to exceed a disinterested
appraisal of same. Said property being:
Lot Number Nineteen (19), Sandstone Addition, an
addition to the City of College Station, Texas, as
shown by the plat recorded in Volume 389, Page
179, of the Deed Records of Brazos County, Texas,
free and clear of any applicable deed restrictions
affecting the city's use of such property for a
park or fire substation.
and the transfer and expenditure of funds for such purpose
is authorized as follows:
IT IS FURTHER RESOLVED that the City Manager and City
Attorney are authorized to take whatever acts are necessary
and appropriate on behalf of the City to accomplish said
transaction, and to obtain marketable title to said property
including the right to use same for the above purposes,
together with the improvements located thereon and described
herein, and to obtain title insurance assuring the
marketable title to said property.
This resolution shall authorize the initiation of
condemnation proceedings where necessary to obtain said
property or remove any restrictions on the use of same which
are inconsistent with the public purpose for which the
property is to be acquired, and appeal from any award which
is deemed to be excessive in the opinion of the City
Attorney.
