AN ORDINANCE REZONING TWO TRACTS OF LAND LYING AND BEING SITUATED IN THE SOUTHWEST ROBERTSON LEAGUE IN BRAZOS COUNTY, TEXAS, COLLEGE STATION, TEXAS, BOTH TRACTS BEING A PART OF A 93.75 ACRE TRACT OF LAND CONVEYED TO R.W. BUTLER BY B.F.SWINDLER, AND THE 93.75 ACRE TRACT BEING THE SAME LAND CONVEYED TO B.F.SWINDLER BY BEADLE BEATRICE HROLICKA BY DEED DATED FEBRUARY 13, 1946, AND RECORDED IN VOLUME 123, PAGE 497, DEED RECORDS, BRAZOS COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED BY METES AND BOUNOS IN THE BODY OF THIS ORDINANCE FROM AGRICULTURE-OPEN DISTRICT A-O TO GENERAL COMMERCIAL OISTRICT C-1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: WHEREAS, the City Councll held a public hearing in the Clty Hall at 7:00 P.M. on Thursday, December 8, 1983, on the question of rezoning certain areas within the city llmlts; AND, WHEREAS, the Clty Council has determined the following: To rezone or change the classification of the following two (2) tracts of land lying and being situated in the Southwest Robertson League In Brazos County, College Station, Texas and being more partlcularly described by metes and bounds as follows: TRACT NO. 1: Being a tract o¢ 10.O18 acres of land in the SW Robertson League in said County, a part of a 93.75 acre tract of land conveyed to R.W.Dutler by B.F.Swindler. Said 93.75 acre tract being the same land conveyed to B.F.Swlndler by Birdie Beatrice Hrdlicka by deed dated February 13, 1946, and recorded In Volume 123, page 497, Deed Records, Brazos County, Texas, the said 10.018 acre tract more particularly described by metes and bounds as follows: BEGINNING at an iron rod at the intersection of the Southwest right-of-way llne of State Highway No. 6 and the Southeast right-of-way line of ~ellborn Road. This point als~ belng the most Northerly corner of the said 93.75 acre tract; ~HENCE S 45°47' E along the Southwest rigHt-of-way line of Highway 6 a distance of 785.95 feet to an Iron rod for corner: THENCE S 6751' W through the said 93.75 acre tract a distance of 449.91 Feet to an il.-n rod for corner: THENCE S O° 47~ E continuing through the said 93.75 acre tract a distance of 88.07 'e ' to an iron rod for corner; THENCE S 86°29' W continuing through the said 93.75 acre tract a distance of 445.91 f ~t to an Iron rod For corner in the Southeast line of a public road: THENCE N 1°10~ E along the 5outHeast line of sald publlc road a dlstance of 558.43 Feet to an iron rod on the Southeast line o¢ ~ellborn Road: THENCE N 4G° O8~ E along the SoutHeast line of ~ellborn Road a dlstance of 396.56 feet to the polnt of beginnlng, containing 10.Oi8 acres of land, more or less, all accordlng to a survey made on the ground in January 1964, by J.A.Orr, Registered Public Surveyor. Ordinance No. 1488 Page 2 TRACT NO. 2 Belng a tract of 1.18 acre of land in the S~ Robertson League in said County, and being a part of a 93.75 acre tract conveyed to R.~.Butler by B.F.Swindler, said 93.75 acre tract of land belng the same property conveyed to B.F.Swindler by Birdie Beatrice Hrdlicka by deed dated February 13, 19q6, recorded in Volume 123, page q97, Deed Records, Brazos County, Texas, and the sald 1.18 acre tract being more particularly described by metes and bounds as follows: BEGINNING at an Iron rod at the intersection of the Southwest right-of-way line of State Highway No. 6 and the Southeast right-of-way line of ~ellborn Road, this point also being the most Northerly corner of the said 93.75 acre tract; THENCE S 45° 47~ E along the Southwest right-of-way line of State Highway No. 6 a distance of 785.95 feet to an Iron for the point of beginning of this 1.18 acre tract of land; 67° 51~ ~ through the said 93.75 acre tract a distance of 449.91 feet corner; THENCE S to an iron rod for THENCE S THENCE S THENCE N THENCE THENCE THENCE In the Southwest 0° 47' E a distance of 88.07 feet to an iron rod for corner; 1° 04.~~ W a dlstance of 28.70 feet to an iron rod for corner; 74° 34.81E a distance of 199.42 feet to a fence corner for corner; S 52° 37.0' E a dlstance of 40.80 feet to a fence corner for corner; N 33° 06.0' E a distance of 41.49 feet to a fence corner for corner; N 43° 26.1' E a distance of 277.57 feet to a fence corner for corner right-of-way line of State Highway No. 6; THENCE N 45° 32' ~ wlth the said right-of-way line a distance of 31.20 feet to the point of beginning, containing 1.18 acres of land, more or less, all according to a survey made on the ground in September 1965, by Oavld R. Mayo, Registered Public Sur- veyor. Both tracts described In deed executed by R. ~. Butler to Jerry Shelton, Et Ux dated October 1, 1965, and recorded in Volume 255, page 54, Deed Records, Brazos County, Texas, from Agrlculture-Open District A-O to General Commercial District C-1.
