HomeMy WebLinkAbout12-13-84-21 - Resolution - 12/13/1984RESOLUTION NO. 12-13-84-21 WHEREAS, the City of College Station having determined the necessity of constructing transmission and distribution electric lines parallel to and 55 feet west of the center- line of the Gulf States Utilities 138 KV transmission line between State Highway 30 and Greens Prairie Road; and WHEREAS, the City Council having determined that it is nec- essary to obtain the easement on property owned by Billy Cares, described on the attached Exhibit A to this resolu- tion, and that the public need requires the acquisition of same in such manner as to make the property available for lawful use for such purposes; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of College Station that the easement areas described on Exhibit A attached hereto shall be acquired by the City; the reasonable cash market value of same shall be deter- mined and paid according to law, either by voluntary pur- chase or by condemnation; and that the City Manager, the Mayor, and the City Attorney are authorized to take any and all necessary actions to obtain and pay for such property, including the marketable title thereto, free and clear of any restrictions or covenants inconsistent with the use of same for all lawful public utility purposes. Further, that the City Attorney is by this resolution expressly autho- rized to initiate and pursue condemnation proceedings and any other necessary litigation incident to the purpose herein set forth. Surveyors & E. ngJneers Office Phone 693-3378 · Rt. 3, Box 4'13 COLLEGE STATION, TEXAS 77840 50 ?OOT EASEMENT BILLY CATES TRACT THOMAS CARTUHERS LEAGUE BRAZOS COUNTY, TEXAS 17 AUGUST 1984 Being a strip of land in the Thomas Caruthers League in Brazos County, Texas, fifty (50') feet in width through that 6.33 acre tract conveyed to Billy Cates by deed recorded in Volume 267, Page 153 of the Deed Records of Brazos County, Texas, and lying twenty-five (25') feet each side of the following described centerline: Beginning in the northeast line of the said Billy Cates tract, at a point located N 54 degrees 08' 15" W - 36.4 feet from the most easterly corner of the said Billy Cates tract. Thence S 39 degrees 35' 08" E - 40.3 feet, parallel to and 55' from the centerline of the existing Gulf States Utilities Company power line, to the end of this easement in the southeast line of the said Billy Cates tract, at a point located S 21 degrees 06' 55" W - 10.5 feet from the most easterly corner of the said Billy Cates acre tract.
