WHEREAS, the City of College Station having determined the
necessity of the extension of an electric feeder line for
new customers within the newly annexed area of the City,
and for other public utilities as the need for same shall
arise in the future; and
WHEREAS, the City Council having determined that it is
necessary to obtain an easement on the property owned by
Dwayne L. Rhea, described on the attached Exhibit A to this
resolution, and that the public need requires the acquisi-
tion of same in such manner as to make the property avail-
able for lawful use for such purposes;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of College Station that the easement area described on
Exhibit A attached hereto shall be acquired by the City;
and the reasonable cash market value of same shall be
determined and paid according to law, either by voluntary
purchase or by condemnation; and that the City Manager, the
Mayor, and the City Attorney are authorized to take any and
all necessary actions to obtain and pay for such property,
including the marketable title thereto, free and clear of
any restrictions or covenants inconsistent with the use of
same for all lawful public utility purposes. Further, that
the City Attorney is by this resolution expressly autho-
rized to initiate and pursue condemnation proceedings and
any other necessary litigation incident to the purpose
herein set forth.

Being a strip of land in the Robert Stevenson League in Brazes
County, Texas, twenty (20') feet in width through that 15 acre
tract conveyed to Dwayne 5. Rhea by deed recorded in Volume 421,
Page 234 of the Deed Records of Brazes County, Texas, and lying
ten (10') feet each side of the following described centerline:
Beginning in the northwest line of the said Rhea tract which is
also the southeast line of that 5 acre trac~ conveyed to Patrick
Parrell by deed recorded in Volume 383, Page 223 of the Deed
Re,;ords of Brazo~ County, Texas, at a poin~ lock, ted S 4.0 degrees

United Four Joint Venture by deed recorded in Volume 564, Page
504 of the Deed Records of Brazes County, Texas, at a point
located S 40 degrees 59' 52" W- 102.75 feet from an iron stake
found marking the common corner of the said Rhea 15 acre tract
and the said United Four Joint Venture 750.55 acre tract in the
southwest line of State Highway No. 6.
