WHEREAS, the City of College Station having determined the
necessity of constructing a 12.5 KV overhead distribution
line generally parallel to and just south of the southerly
right-of-way line of Rock Prairie Road, and transmission
and distribution electric lines parallel to and 55 feet
west of the centerline of the Gulf States Utilities 138 KV
transmission line between State Highway 30 and Greens
Prairie Road; and
WHEREAS, the City Council having determined that it is
necessary to obtain the easements on property owned by
Menlo Properties, described on the attached Exhibits A and
B to this resolution, and that the public need requires the
acquisition of same in such manner as to make the property
available for lawful use for such purposes;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of College Station that the easement areas described
on Exhibits A and B attached hereto shall be acquired by
the City; the reasonable cash market value of same shall be
determined and paid according to law, either by voluntary
purchase or by condemnation; and that the City Manager, the
Mayor, and the City Attorney are authorized to take any and
all necessary actions to obtain and pay for such property,
including the marketable title thereto, free and clear of
any restrictions or covenants inconsistent with the use of
same for all lawful public utility purposes. Further, that
the City Attorney is by this resolution expressly autho-
rized to initiate and pursue condemnation proceedings and
any other necessary litigation incident to the purpose
herein set forth.

Being a strip of 3and in the Thomas Caruthers League in ~razos County,
Texas, twenty (20') feet in width through that 120.398 acre tract
conveyed to Menlo Properties by deed recorded in Volume 567, Page 759
of the Deed Records of Brazos County, Texas, and lying ten (10') feet
each side of the following described centerline:
Beginning in the northwest line of the said Menlo Properties tract
which is also the southeast line of that 2.0 acre tract conveyed to
Leldon C. Thompson by deed recorded in Volume 341, Page 552 of the
Deed Records of Brazos County, Texas, at a point located S 42 degrees
16' W - 12.0 feet from the common corner of the said Leldon C.
Thompson 2.0 acre tract and the said Menlo Properties 120.398 acre
tract in the southwest line of Rock Prairie Road.
Thence S 76 degrees 27' 30" E - 1215.4 feet to the end of this
easement in the southeast line of the said Menlo Properties 120.398
acre tract which is the northwest line of that 119.53 acre tract
conveyed to City of College Station, Texas, by deed recorded in Volume
486, Page 646 of the Deed Records of Brazos County, Texas, at a point
located S 41 degrees 56' W - 13.7 feet from the common corner of the
said Menlo Properties 120.398 acre tract and the said City of College
Station 119.53 acre tract in the southwest line of Rock Prairie Road.

17 AUGUST 1984
Being a strip of land in the Thomas Caruthers League in Brazos County,
Texas, fifty (50') feet in width through that 120.398 acrs tract
conveyed to Menlo Properties by deed recorded in Volume 567, Page 759
of the Deed Records of Brazos County, Texas, and lying twenty-five
(25') feet each side of the following described centerline:
Beginning in the northeast line of the said Menlo Properties tract, at
a point located S 76 degrees 31' 59" E - 150.5 feet from the most
northerly corner of the said Menlo Properties tract, in the southwest
line of Rock Prairie Road.
Thence S 39 degrees 35' 08" E- 947.1 feet, parallel to and 55' from
the centerline of the existing Gulf States Utilities Company power
line, to the end of this easement in the southeast line of the said
Menlo Properties tract, at a point located S 41 degrees 56' 16" W -
647.7 feet from the most easterly corner of the said Menlo Properties
120.398 acre tract.
