'1420 AN ORDINANCE REZONING THREE TRACTS OF LAND LYING AND BEING SITUATED IN THE RICHARD CARTER SURVEY, ABSTRACT #8, BRAZOS COUNTY, TEXAS AND BEING A PORTION OF A 13.54 ACRE TRACT CON- VEYED TO UNIVERSITY EAST JOINT VENTURE BY SYLVIA PUTZ WILLINGHAM BY DEED RECORDED IN VOLUME 3~8, PAGE 709 OF THE DEED RECORDS OF BRAZOS COUNTY, TEXAS AND BEING MORE PARTI- CULARLY DESCRIBED BY METES AND BOUNDS IN THE BODY OF THIS ORDINANCE FROM SINGLE FAMILY RESIDENTIAL DISTRICT R-1 TO AOMINISTRATIVE-PROFESSIONAL OISTRICT A-P, APARTMENTS LOW DENSITY DISTRICT R-q ANO SINGLE FAMILY RESIDENTIAL OISTRICT R-IA. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: WHEREAS, the City Council April 28, 1983 the city Iimits; held a public hearing in the City Hall at 7:00 P.)~. on on the question of rezoning certain areas within AND, WHEREAS, the City Council has determined the following: To rezone or change the classification of the following three (3) tracts of land lying and being situated in the Richard Carter Survey in College Station, Brazos County, Texas and being more fully described by metes and bounds as follows: TRACT NO. I BEGINNING at the North corner of the aforesaid 13.54 acre tract, same lying on the Southeast right-of-way )ine of University Drive: THENCE S ~5°28~00'E along the Northeast line of the 13.5q acre tract for a distance of 313.23 feet to a point for corner, THENCE S ~4°32'38"W for a distance of 602.46 feet to a point on the Southwest line of the said 13.5q acre tract; THENCE N 45°20100'1W For a distance of 377.32 Feet to an angle point: THENCE N 14°51~13"W for a distance of 225.58 feet to the West corner of the said 13.54 acre tract, same lying on the Southeast right-of-way line of University Drive: THENCE N 72°27'00"E along the Southeast right-of-way line of University Drive for a distance of 551.80 feet to the PLACE OF BEGINNING and containing 6.20 acres of land, more or less From Single Family Residential District R-1 to Administrative-Professlonal Distrlct A-P. TRACT NO. 2 BEGINNING at the North corner of the aforesaid 13.t'' acre tract, same lying on the Southeast right-of-way llne of University Drive' THENCE S qS°28'OO"E along the Northeast line of the 13.5q acre tract for a distance of 313.23 Feet to the PLACE OF BEGINIiING: THENCE continulng S qS°23100"E for a distance of 306.18 feet to a point for corner; THENCE 5 44°32~38"U for a distance of GO2.~ Feet to a point 1yin9 on the S~uthwest line of the said 13.5q acre tract; 03Ek33 ORDINANCE NO. 1420 page 2 THENCE N 45°28'00"W along the Southwest line of the 13.54 acre tract for a distance of 306.18 feet to a point for corner; THENCE N 44°32'38"E for a distance of 602.46 feet to the PLACE OF BEGINNING and con- taining 4.23 acres of land, more or less from Single Family Resldential District R-I to Apartments Low Density District R-4; AND, PROVIDED that this tract of land shall at all times have a masonry structural wall at least 6 feet in height running from property line to property line, which divides this R-4 zoned tract from the adjacent Single Family Resldential District R-IA tract to the south, and that an acceptable maintenance arrangement concerning said wall shall be approved by the City Attorney and implemented prior to the issuance of any Certificate of Occupancy. TRACT NO. 3 BEGINNING at the North corner of the aforesaid 13.54 acre tract, same lylng on the Southeast right-of-way line of University Drive; THENCE S 45°28'00"E along the Northeast line of the 13.54 acre tract for a distance of 619.41 feet to the PLACE OF BEGINNING; THENCE continuing S 45°28'00"E for a distance of 200.00 feet to the East corner of the 13.54 acre tract; THENCE S 44°32'38"W along the Southeast line of the 13.54 acre tract for a distance of 602.46 feet to the west corner of the 13.54 acre tract; THENCE N 45°28'00"W along the Southwest line of the 13.54 acre tract for a distance of 200.00 feet to a point for corner; THENCE N 44°32138"E for a distance of 602.46 feet to the PLACE OF BEGINNING and containing 2.77 acres of land, more or less, from Single Family Residential District R-I to Single Family Residential District R-IA. AND, PROVIDED that thls tract of land shall be limited in development to a maximum of eleven (11) total dwe111ng units. And, it is ordained that said changes shall become effective immediately.
