RESOLUTION
BE IT BE RESOLVED BY THE CITY COUNCIL OF THE CITY OF College Station
SECTION 1. That the certain agreement dated Io/~+/~q between the State
of Texas and the City of College Station , for the blanket coverage of
various projects covering the installation, construction, existence, use, opera-
tion, and maintenance of certain highway traffic signals/illumination in the
City of College Station , be, and the same is hereby approved, and ~A~y~r
is hereby authorized to execute said contract on behalf of said city and to
transmit the same to the State of Texas for appropriate action.
SECTION 2. That this Resolution shall take effect immediately upon its passage.

This AGREEMENT, dated this 14th day of October , 19.87 , by and between
the State of Texas, hereinafter called the "State," Party of the First Part; and
the City of College Station , Brazos County, Texas, acting by
and through its duly authorized officers under a~~/Resolution, passed
the .14th day of October , 19~7, hereinafter called the "City," Party of the
Second Part, is made to become effective when fully executed by' both parties.
WITNESSETH
WHEREAS, the City has authorized the installation of traffic aignal(~) by
~Resolution, passed on the 14th day of October , 19 87 , at the
location(~ shown on EXHIBIT 1, attached hereto and made a part hereof; and
WHEREAS, the State under provisions of The Texas Register Title 43, TAC 25.5,
has authority to install traffic signals on non-freeway locations within cities of
over 50,000 population, and on non-highway routes in cities with less than 50,000
population when the installation(~ is(~ eligible for reimbursement from
Federal Aid funds; and
WHEREAS, the State wishes to cooperate with the City in the installation of
the traffic signal(~ at the location(l~ shown in EXHIBIT 1;
AGREEMENT
NOW, THEREFORE, in consideration of the premises and of the mutual covenants
and agreements of the parties hereto to be by them respectively kept and
performed, as hereinafter set forth, it is agreed as follows:

1. This Agreement shall apply to all highway traffic signal installations
approved by both the State and the City, the City's approval being indicated by
signature of the ~l~y ~ycr o~ ~.'H~¢ ~'~ I-~a$ on the plan
title sheet for such installation. Highway traffic signal installations made a
part of this agreement shall contain on the title sheet.the following statement:
"The City hereby consents to the construction of this
Highway Traffic Signal as to location and manner of
construction as indicated on these plans, said installa-
tion being a part of "Agreement (Traffic Signal
- Type r), dated ."
2. The State will furnish the necessary funds for the actual construction,
prepare plans and specifications, insta,ll said highway traffic signal~ and
supervise construction.
3. The City hereby consents to the construction of the highway traffic
signal~/0 by the approval of the location and manner of construction as shown on
plans and described in specifications.
4. The City will operate and maintain the highway traffic signal(Y~ at their
expense upon completi~z~ of the installation0~ by the State.
5. The City will pay all power costs for operating the signal(Y~, including
all power necessary for installation and testing of the signals prior to comple-
tion of the installation by the State.
6. The City will obtain approval of the State Department of Highways and
Public Transportation before making any major changes in the design and operation
of the signal(~.

7. The City will return any and all parts of said highway traffic signal
installacioni(/O to the State should it ~ be removed by the City for any
reason other than for installation on a State or Federal numbered highway route ac
a location approved by the State.
8. The City will be responsible for the police enforcement required for
securing obedience to the highway traffic signal(~0.
9. In the event the signal(~) installed in accordance with this Agreement
become unnecessary or are removed for any reason, this A~reement shall terminate.
10. To the extent permitted by law, the City shall indemnify and save
harmless the State~ its agents or employees, from all suits, actions or claims and
fro= all liability and damages for any and all injuries or damages sustained by
any person or property in consequence of any neglect in the performance, or
failure of performance of the City~ its agents and employees under this A~reement.
11. The State wiiI not incur any financial obligation to the City as a
result of this A~reement.
