HomeMy WebLinkAbout02-25-88-12 - Resolution - 02/25/1988 ',; .... 02 '~5 88 ~ RESOLUTION NO. .-...- -12 ,C~t> ~.~ ,::ll','"~d A RESOLUTION OF THE CITY OF COLLEGE STATION ENDORSING THE ~. ~ APPLICATION ACTIONS OF THE BRAZES VALLEY COMMUNITY ACTION i, "---T~.~ AGENCY IN ORDER THAT THE AGENCY MAY OBTAIN SPECIFIED FED- ~ ERAL FUNDING, AGREEING THAT THE SAID AGENCY IS A SEPARATE : APPLICANT FROM THE CITY OF COLLEGE STATION, PROVIDING FOR J INDEMNIFICATION, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of College Station has been designated by ".' the Governor and the Urban Mass Transportation Administra- tion (UMTA) as an eligible recipient to receive Section 9 funding; and, WHEREAS, the federal Urban Mass Transportation Administra- tion has a program of funding for transportation capital improvement known as Section 9 funding; and, WHEREAS, the Brazes Valley Community Action Agency (BVCAA), a body corporate independent and separate from the City, desires to seek additional UMTA funding through the Section 9 Program to maintain and enhance its existing transportation services within the City; and, WHEREAS, the City's endorsement of BVCAA's request is a necessary prerequisite in order that BVCAA may apply for federal funding; and, WHEREAS, the BVCAA will provide all the local share re- quired for the proposed transportation services and the acquisition of vehicles and capital construction; NOW, THEREFORE, BE IT RESOLVED By the City Council of the City of College Station: SECTION 1. The City Council endorses the BVCAA re- quest to the Urban Mass Transportation Administration for Section 9 funding to maintain and enhance existing BVCAA transportation services within the City. r~ SECTION 2. The City Council endorses the designation of BVCAA as an additional recipient to receive UMTA Section 9 funding. ",::ri, ~d SECTION 3. The City approves of BVCAA acting as a /'~,~""': separate applicant to secure Section 9 UMTA funding and _ . '.,... ':,'~ ,- . ........ City's endorsement is premised upon the following: 1) BVCAA is a body corporate independent and separate from the City. 2) BVCAA seeks only the City's endorsement in its application for Section 9 funding. 3) BVCAA shall hold harmless and indemnify City for negligent and intentional acts of BVCAA, as well as the acts of its agents, employees, and assigns. BVCAA shall also hold City harmless for attorneys fees. .ill 4) BVCAA shall, at no time or in no manner, represent or otherwise hold itself out as acting on or in behalf of City. .,, 5) BVCAA shall be directly responsible to UMTA for ,,,. fulfilling all project requirements and all ~ procedures and requirements therein. ,,' ~( 6) BVCAA shall, at no time, interfere with or ~ ~, conflict with anything the City may choose to do ~..(<~ itself in the area. · "~. ~ SECTION 4.
