HomeMy WebLinkAbout02-25-88-08 - Resolution - 02/25/1988 RESOLUTION NO. 02-25-88-08 A RESOLUTION AUTHORIZING THE MAYOR OF THE CITY OF COLLEGE STATION,~ TEXAS, TO ENTER INTO AN AGREEMENT WITH THE BRYAN INDEPENDENT ~SCHOOL DISTRICT, TO INCLUDE VOTERS WHO LIVE IN COLLEGE STATION TO VOTE IN PRECINCT NO. 24 FOR THE BRYAN INDEPENDENT SCHOOL DISTRICT ELECTION FOR BOARD OF TRUSTEES. In accordance with the College Station City Charter and the Elec- tion Code of the State of Texas, the City of College Station, Texas annually holds a general election for the purpose of elec- iting officers to the City Council; and, WHEREAS, one of the city voting precincts is Precinct No. 24, which is also county voting Precinct No. 24, the boundaries of said precinct being located entirely within the city limits of College Station, Texas,' and, all qualified voters within Precinct No. 24 are eligible to vote in said city election; and, ~.~... WHEREAS, the designated polling place for Precinct No. 24 is the College Hills Elementary School, which is the place of voting for all qualified electors voting within Precinct 24 in the city election; and, WHEREAS, the metes and bounds of said Precinct No. 24 are located within two different school districts, those being the College Station Independent School District and the Bryan Independent School District, with a large majority of the inhabitants being members of the College Station Independent School District who are-- eligible to vote in the College Station Independent School Distric election for Board of Trustees; and, said electors in the College Station Independent School District election vote at Precinct No. 24; and, WHEREAS, the small number of College Station residents of said Precinct No. 24 who are members of the Bryan Independent School District and are eligible to vote in the Bryan Independent School District for Board of Trustees have heretofore traveled into an adjacent voting precinct, specifically to the voting place for county voting Precinct No. 27, to vote in the Bryan Independent School District Board of Trustees election; and, WHEREAS, the Texas State Election Code, Section 271.003, allows for a common polling place to be located to serve the affected voters in a situation of this nature, in order to facilitate the orderly conduct of the election. PAGE 2 02-25-88-08 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of College Station, Texas that the Mayor is hereby authorized to enter into an agreement with the Bryan Independent School Dis- trict, to include voters who live in College Station, Texas and specifically within city voting Precinct No. 24, to vote in Pre- cinct No. 24 for the Bryan Independent School District election for Board of Trustees. STATION, TEXAS, AND THE BRYAN INDEPENDENT SCHOOL DISTRICT This AGREEHENT is entered into by and between the City of College Station, Texas, and the BISD; both parties having considered the need to facilitate voting arrangements for certain electors residing inside Voting Precinct No. 24 within the city boundaries of College Station, Texas, do hereby agree to the following provisions, promises and covenants: The BISD shall furnish all equipment, supplies, and personnel necessary to allow voters who reside in College Station, Texas, and also within the boundaries of the BISD, to vote in Precinct No. 24 in a general election called by said BISD for the purpose of electing members to the Board of Trustees. PERSONNEL shell include but not be limited to one or more clerks, at least one of whom shall be present at Precinct No. 24 place of voting, from a time no later than thirty minutes prior to the openin~ of the polls on election day, until such time that the polls have closed at ?:00 P. M. and voting has been completed. All appointment of personnel, remuneration for same, and paperwork incidental to the election, shall be t_he sole responsibility of the BISD. 2. EQUIPMENT and SUPPLIES shall include but not be limited to the following items: (a) One box for the receipt of voted ballots; said box shall be locked prior to its delivery to Precinct No. 24 and shall remain locked with the key held in the custody of the BISD election Judge for Precinct No. 27. Said locked box shall be plainly marked "Bryan Independent School District Election Only". (b) One or more voting booths; also, punch cards prepared for the BISD election only; no other races or propositions shall be printed thereon. (c) A poll list of qualified voters, prepared by the Brazos County Registrar of Voters. (d) A signature roster, a copy of the Election Order, and all other materials and supplies necessary to the holdinE of a school board election as prescribed by the Election Code of the State of Texas. -2- Any procedures necessary to qualify or assist any voter desiring to vote in the BISD election, shall be the responsibility of the BISD election clerk. After the polls close at ?:00 P. M. and all qualified electors waiting in line prior to ?:00 P. M. have been allowed to vote, the BISD locked box containing the voted ballots shall be delivered to the Presiding Judge at Precinct No. 27 by the BISD election clerk from Precinct No. 24. The City of College Station acknowledges that this Joint agreement is undertaken to accommodate certain voters, who are citizens of the City; agrees that no charge shall be made to the BISD on behalf of the city for the carrying out of this Agreement; realizes that the BISD shall pay any and all of its own expense incurred under this action; and, understands that all voting equipment used by the different entities shall be clearly marked and kept distinct, separate and apart. This AGREEMENT shall remain in full force and effect so long as it is mutually deemed to be of benefit to the affected voters; however, should one party desire to terminate the AGREEMENT, it may do so by giving thirty days written notice posted by certified mail and stating the reason for termination, with said thirty days beginning on the date said notice is received in the Office of the City Secretary, in the case of the City of College Station, or in the Office of the Executive Secretary to the Board of Trustees, in the case of the BISD.
