WHEREAS, the City of College Station, Texas and the Brazos Valley
Community Action Agency have previously entered into an
agreement for services under the Emergency Food Assis-
tance Food Program; and
WHEREAS, under said agreement the BVCAA has distributed Title II.
commodities, including butter, processed cheese, honey,
powdered milk, and rice, to eligible individuals in the
City of College Station; and
WHEREAS, it has been shown that residents of this city and of the
community at-large have benefited from distribution of
these needed food stuffs; and
WHEREAS, said distribution agreement has expired and must be
renewed in order to continue this very important proj-
ect.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
College Station, Texas that the City Manager is hereby authorized
to enter into an agreement with the Brazos Valley Community
Action Agency for the performance of services under the Emergency
Food Assistance Program.

The Brazos Valley Co~unity Action Agency, hereinafter referred to as the
Agency, and C%~¥ of Colleae Station hereinafter
referred to as the Contractor hereby make and enter into this agreement for
services under the Emergency Food Assistance Program.
The Parties agree as follows:
The Contractor:
A.
The Contractor agrees to distribute Title II c~odities to individuals in
the following city(s) city of Colleqe Station ·
B. The Contractor agrees that co~nodities received under this contract shall
be used for distribution to eligible individuals as defined by the Texas
Department of Human Services (TDHS), in such amounts as authorized by
TDH$.
C. The Contractor agrees that commodities received under this contract will
only be used for the purposes specified and will not be sold, traded, or
otherwise disposed of without prior approval of the Agency.
D. The Contractor agrees that commodities will be made available to all
eligible individuals regardless of race, color, national origin, sex, age,
or handicapping conditions.
E. The Contractor agrees that no palanents, no donations, no materials or
services shall be required or accepted from eligible individuals under any
circumstances.
F. The Contractor agrees that membership in a specific organization,
attendance at the meeting of a specific organization, or membership dues
shall not be required of applicants for emergency food.
G. The Contractor agrees to publicize the date, time and location of
commodities distributions.
H. The Contractor will not issue any foods that are in questionable condition
and will immediately call the local health agency for an inspection of the
food. Health agency instructions will be followed. The contractor will
report the findings to the Agency.
I. The contractor will complete all required forms in an accurate manner.
J. The contractor will forward all forms to the Agency following each
distribution.
K. The Contractor will be responsible for any improper distribution or use of
con~odities, including loss of, or damage to, commodities caused by fault
or negligence.

Any commodities remaining on hand after the ending date of this contract
or upon termination of this contract will be disposed of in accordance
with instructions from the Agency.
The Agency:
A. The Agency agrees to provide USDA-donated co~modities in amounts it deems
appropriate for distribution.
B. The Agency agrees to provide guidance on the receipt and storage of
con~nodities.
C. The Agency agrees to provide application/eligibility determination/
distribution forms, income eligibility and distribution guidelines.
D. The Agency agrees to provide technical assistance or guidance upon
request.

This contract may be cancelled by mutual consent; however if such mutual
consent cannot be attained, then and in that event, either party to this
contract may consider it to be cancelled without cause by the giving of thirty
(30) days notice in writing to the other party and this contract shall
thereupon be cancelled upon the expiration of such thirty (30) day period.
III
For the faithful performance of the terms of this contract, the parties hereto
in their capacities as stated, affix their signature and bind themselves
effective from January 1, 1988 and continuing through December 31, 1988.
