Agenda Item No. 1 - Approval of the minutes of the City Council Workshop Meeting, April 27, 1988 and the Regular meeting April 28, 1988. Councilman Gardner corrected paragraph five of page four of the April 28th minutes to read - "Councilman Gardner commented that granting this rezoning would diminish the credibility of the Comprehensive Plan." He also corrected paragraph three of page five of the same minutes to read - "Councilman Gardner commented that this council may be willing to sacrifice public safety and convenience to make this one particular business work". He substituted "are" to replace "may be" other uses ..." in the last sentence of paragraph three. Councilman Gardner moved approval of the minutes as corrected. Councilman Haddox seconded the motion which carried unanimously, 4-0. Agenda Item No. 2 - A public hearing to determine the necessity for paving Fidelity Street from Highland Street to Montclair Street. Assistant City Engineer Smith described this item. He stated that a petition was received on March 25th with six signatures repre- senting the block of Fidelity Street from Highland Street to Montclair Street. The first public hearing required is to con- sider whether or not to make curb and gutter improvements. 06665 CITY COUNCIL REGULAR MEETING THURSDAY, MAY 12, 1988 Page 2 City Attorney Locke pointed out that at the next council meeting an ordinance amending the City Code will be considered to determine the maximum allowable assessments against property owners. Mayor Ringer opened the public hearing. Mr. Kyle Pugh of 305 Fidelity came forward to request that the City approve curb and gutter improvements to the street. Mr. David Burdick of 302 Fidelity addressed the Council. He concurred with Mr. Pugh's comments. He asked if $20.00 per foot is the maximum assessment on this project. He remarked that he would not want to pay a higher cost than $20.00 per foot. He also inquired as to the financial options the property owners may have. Mayor Ringer answered Mr. Burdick's questions. He stated that state law permits the City to assess up to 90 percent of the costs of the street and 100 percent of the curb and gutter to the property owners; the final decision is made by the City Council. City Attorney Locke further explained that the interest rate would be set at eight percent. Also, a lien note is attached to the property. She noted that it is at the discretion of the Council to set a time period for payment. Mrs. Helen Pugh owner of 305 Fidelity addressed the Council. She supported the curb and gutter construction and added that she would like to see the construction extended to Fairview Street. Mr. Smith responded that a petition should be signed from the residents on the side street of Fidelity in order that the project can be extended to Fairview. Ms. Janna Keel of 601 Montclair addressed the Council. expressed her support for this paving project. Agenda Item No. 3 - A public hearing on the question of annexing a 505.64 acre tract located approximately 200' west of Rock Prairie Road and approximately 7000' south of Greens Prairie Road. (88-601) Director of Planning Callaway explained that this tract of land is 06666 CITY COUNCIL REGULAR MEETING THURSDAY, MAY 12, 1988 Page 3 the site of Lick Creek Park and Lick Creek Wastewater Treatment Plant owned by the City of College Station. Annexation of this tract will bring the park and treatment plant into the City's service area. Councilman Gardner asked for the width measurement of 7.9 acres of parkland dedicated by W.D. Fitch. Mr. Callaway replied that the width of the easement is 190 feet. Mayor Ringer opened the public hearing. No one spoke. Mayor Ringer closed the public hearing. Agenda Item No. 4 - A public hearing on the question of annexing a 35 acre tract of land located along the north side of Graham Road approximately 2200' west of Texas Avenue (88-600). Mr. Callaway explained this item. He stated that annexation of this tract will bring the Utility Service Center into the City. Mayor Ringer opened the public hearing. No one spoke. Mayor Ringer closed the public hearing. Agenda Item No. 5 - Presentation of Service Plaques to City Council members. Mayor Ringer presented a service plaque to Councilman Haddox for his two years of service on the Council. Councilman Boughton and Councilman Grona were not present to receive their plaques. Mayor Ringer also received a plaque for his service as Mayor. Agenda Item No. 6 - New City Council members to take Oath of Office. Presentation of Certificates of Election. With City Judge Banks officiating, the oath of office was taken by Larry Ringer, Mayor; Dick Birdwell, Councilman Place 2; Vernon Schneider, Councilman Place 4; Dick Haddox, Councilman Place 6. Mayor Ringer presented the new Councilmembers with their Certifi- cates of Election. Mayor Ringer welcomed Mr. Schneider and Mr. Birdwell to the Council. He expressed his appreciation for the service of Mrs. Boughton who has served on the Council for ten years and has devoted much of her efforts to the Council and to the City; she will be missed by all. 06667 CITY COUNCIL REGULAR MEETING THURSDAY, MAY 12, 1988 Page 4 Mayor Ringer noted that he has assigned the council members to various council committees. He also mentioned that the council will begin appointing members to various citizen committees and boards at their next council meeting, May 26th. Agenda Item No. 7 - Adjourn.
