HomeMy WebLinkAbout1984-1557 - Ordinance - 11/08/1984ORDINANCE NO. 1557 AN ORDINANCE AMENDING CHAPTER 10, TRAFFIC CODE, OF THE CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION, TEXAS, TO INCLUDE SECTION 3F. REGULATING TRAIN SPEEDS WITHIN THE CITY LIMITS. WHEREAS, the City of College Station City Council met at a regular meeting of the City Council on November 8, 1984. A public hearing was held to co~sider the necessity of an Ordinance regulating the speed of trains throughout the 3urlsdiction of the City of College Station; WHEREAS, it has been determined that the population growth within the City has caused increased traffic over the railroad crossings within the city limits, including those located within the boundaries of the Texas A & M University campus; THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF TEE CITY OF COLLEGE STATION, TEXAS: That this ordinance is hereby adopted, amending Chapter 10 of the Code of Ordinances of the City of College Station, Texas, to include Section 3F providing for the regulation of train speeds within the city limits as follows: F. SPEED LIMITS ESTABLISHED FOR TRAINS (1) Upon any railroad track located between the points designated in this Section, it shall be unlawful for any railroad train, car, engine or locomotive to run at a speed greater than the maximum speed or the minimum speed prescribed as follows: LOCATION OF TRACKS MAXIMUM SPEED/MPH MINIMUM SPEED/MPH FM 2818 and Holleman Drive 40 10 Holleman Drive and the city limits of Bryan at Villa Maria Road 30 10 In the event that there is no railroad crossing at the roadway indicated, either by virtue of abandonment or proposed installation, the engine speed shall be reduced to the lowest speed at the location of the closest direct contact of the street measured on a perpendicular line to the railroad tracks. Ordinance No. 1554 (2) Train speed shall be calculated by the speed of the t~ain engine or locomotive. The speed shall be determined by K55MPH Industries, Dopler Radar, or other Dopler Radar certified for service and College Station Police Department approved, pacing by a City of College Station Police Department police vehicle with a speedometer that is service certified and College Station Police Department approved, or by any other technologically reliable speed detection method or device. (3) It shall be unlawful to stop or cause to be stopped any railroad train, locomotive, engine, or car across any street, road or highway within the city limits so as to obstruct or interfere with the passage of vehicular or pedestrian traffic thereon for a period of time in excess of five minutes. II. violation of any of these Sections shall be considered a misdemeanor punishable by a fine up to Two Hundred ($200.00) Dollars, exclusive of Court costs and taxes imposed by State law. Citation will be issued to the individual deemed by the Officer to be in charge of the operation of the train. PASSED, ADOPTED AND APPROVED this 8th day of November , 1984.
