HomeMy WebLinkAbout1984-1526 - Ordinance - 06/14/1984ORDINANCE NO. 1526 AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT STYLED "MUTUAL AID AGREEMENT". WHEREAS, the City of College Station Fire Department and Legal Department prepared a Mutual Aid Agreement for the benefit of the City of College Station and the delineation of responsibilities of the City of College Station Fire Department in supplying aid to the City of Bryan. Further, that the City of College Station, by the preparation of the Mutual Aid Agreement has attempted to positively affect its insurance rates; and WHEREAS, the City of Bryan was presented with the Mutual Aid Agreement; and the City of Bryan City Council having considered and approved the Mutual Aid Agreement and returned it to the City of College Station for the City Council of the City of College Station to consider; THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF CITY OF COLLEGE STATION, TEXAS: That the City of College Station has reviewed and considered the Mutual Aid Agreement presented and hereby authorizes the Mayor to execute the agreement which is attached hereto and styled "Mutual Aid Agreement". ATTEST: City Se6r~ta~5; APPROVEE~ / ./ ~ MUTUAL AID AGREEMENT THE STATE OF TEXAS ) COUNTY OF BRAZOS ) THIS AGREEMENT is made and entered into this the 14th day of June 19 84 · __, by and between The City of College Station, Texas, a Home Rule Municipal Corporation of the State of Texas, hereinafter referred to as COLLEGE STATION, and The City of Bryan, Texas, a Home Rule Municipal Corporation of the State of Texas, hereinafter referred to as BRYA~, each acting herein by and through its duly authorized officials; WHEREAS, COLLEGE STATION and BRYAN are the owners of certain trucks and other equipment designed for and capable of being used in the protection of persons and property from and in the suppression and the fighting of fires, and has in its employ individuals trained in the use of such equipment, the same being and composing the fire departments of each of the above referenced cities; and WHEREAS, COLLEGE STATION and BRYAN are the owners of certain of the mutual benefits to be derived by each of the Parties hereto, which said Parties now agree to be a valuable and sufficient consideration, said Parties agree in covenant as follows: I. COLLEGE STATION will provide fire equipment services to points in BRYAN on calls made to the City's Central Fire Station by the appropriate official from BRYAN. BRYAN will provide fire equipment services to points in COLLEGE STATION on calls made to the City's Central Fire Station by the appropriate official from COLLEGE STATION. II. After the call, the City which has supplied the service shall within thirty (30) days submit to the receiving City an itemized list of all supplies, chemicals and other consumable products used in fighting fires or safeguarding persons or property, and the City receiving such service shall replenish within sixty (60) days those items consumed. III. shall determine that the health, safety and welfare of the citizens of COLLEGE STATION would be endangered by dispatching men and equipment outside its Corporate limits. BRYAN reserves the right to refuse to answer any call pursuant to this Agreement in the event the Fire Chief of BRYAN or his designate shall determine that the health, safety and welfare of the citizens of BRYAN would be endangered by dispatching men and equipment outside its Corporate limits. V. Fire Chief of the City providing the service shall be the sole judge of the type and amount of equipment and manpower dispatched to calls pursuant to this Agreement, and said Fire Chief or his designate shall submit to the orders of the Fire Chief of the City receiving the service or his designate as to fire fighting techniques used in response to any said calls. However, in the event that the Fire Chief of the City providing the service or his designate determines that the health, safety and welfare of his personnel shall be endangered by any order, he shall appropriately
