A RESOLUTION AUTHORIZING THE MAYOR, CITY MANAGER AND
CITY ATTORNEY TO ACQUIRE 6.63 ACRES IN THE MORGAN
RECTOR LEAGUE FOR USE AS PARK LAND AND FOR DRAINAGE BY
THE CITY OF COLLEGE STATION, TEXAS.
WHEREAS, the City of College Station having determined
the necessity of developing park land and improving
drainage along Wolf Pen Creek in the City of College
Station; and
WHEREAS, the City Council having determined that it is
necessary to acquire the property described in Exhibits
"A" and "B" attached to this Resolution, and that the
public need requires the acquisition of same in such
manner as to make the property available for lawful use
for such purposes;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of College Station that the property described
in Exhibits A and B attached hereto shall be acquired
by the City; and the reasonable cash market value of
same shall be determined and paid according to law,
either by voluntary purchase or by condemnation; and
that the City Manager, the Mayor, and the City Attorney
are authorized to take any and all necessary actions to
obtain and pay for such property, including the mar-
ketable fee simple title thereto, free and clear of any
restrictions or covenants inconsistent with the use of
same for all lawful purposes. Further, that the City
Attorney is by this resolution expressly authorized to
initiate and pursue condemnation proceedings and any
other necessary litigation incident to the purpose
herein set forth.

conveyed to Statesman Bank for Savings, FSB, by deed recorded in Volume 1071, Page
455 of the Official Records of Brazos County, Texas, and being more particularly de-
scribed as follows:
Beginning at an iron rod found at the intersection of the southeast line of the said 32.28
acre tract and the northeast line of Dartmouth Street.
Thence N 42° 38' 50' E - 714.99 feet along the southeast line of the said 32.28 acre tract
and the northwest line of that 31.66 acre tract described in a deed to Simon Kahan and
rec?rded in Volume 1036, Page 437 of the Official Records of Brazos County, Texas, to
an iron set In the southeast line of Holleman Drive;
Thence along the arc of a curve to the right (radius = 1035.00 feet) through a central
angle of 30° 10' 11', the chord of which bears S 63° 20' 46' W - 538.72 feet, to and Iron .
rodfound at the P.T. of said curve, in the southeast line of Holleman Drive;
Thence S 78° 25' 52' W - 46.07 feet continuing along the southeast line of Holleman
Drive to an iron rod found at the P.C. of a curve to the left (radius 52.00 feet);
Thence along the arc of said curve through a cen~al angle of 100° 01' 01' to an iron rod
found at the P.T. of said curve in the northeast line of Da~mouth Street;
Thence S 21° 35' 09' E - 174.57 feet along the northeast line of Dartmouth Street to an
iron rod found at the P.C. of a curve to the right (radius = 1179.94 feet);
Thence along the aro of said curve through a central angle of 2° 12' 29' to the Point of
Beginning and containing 1.59 acres or land more or less.

Official Records of Brazos County, Texas, and being more particularly described as
follows:
Beginning at an iron rod set in the southeast line of the said 31.66 acre tract and the
northwest line of Lot 1 of Block 'C' of Eastmark Subdivision Phase II addition to the City
of College Station, Texas, according to plat of record in Volume 553, Page 645 of the
Deed Records of Brazos County, Texas, at a point S 42' 22' 55' W - 278.28 feet from a
fence corner found at the most easterly corner of the said 31.66 acre tract.
Thence N 47~ 34' 39' W - 316.09 feet through the said 31.68 acre tract to an iron rod set
for the most northerly corner of this tract in the southeast line of Holleman Drive;
Thence S 42' 38' 43' W - 18.71 feet along the southeast line of Holleman Drive to an iron
rod found at the P.C. of a curve to the right (radius = 1035.00 feet);
Thence along the arc of said curve through a central angle of 5° 38' 58' to an iron rod set
at the Intersection of the southeast line of Holleman Dnve and the northwest line of the
said 31.66 acre tract;
Thence S 42' 38' 50' W - 714.99 feet along the northwest line of the said 31.66 acre tract
and the southeast line of that 32.28 acre tract conveyed to Statesman Bank for Savings,
FSB, by deed recorded in Volume 1071, Page 455 of the Official Records of Brazos
County, Texas, to an iron rod found in the northeast line of Dartmouth Street;
Thence alon~g, th?.arc of a curve to the right (radius ,= 1179.94 feet) through a central
angle of 0° 55 38, the chord of which bears S 18' 54 52' E - 19.08 feet, to an iron rod
set at the P.T. of said curve in the northeast line of Dartmouth Street;
Thence S 18° 27' 04' E - 80.92 feet continuing along the northeast line of Dartmouth
Street to an iron rod set for the most southerly corner of this tract;
Thence N 56' 53' 51' E - 240.00 feet through the said 31.66 acre tract to an iron rod set
for an angle point;
Thence S 80~ 42' 14" E - 75.00 feet continuing through the said 31.66 acre tract to an iron
rod set for an angle point;
Thence N 75° 45' 58' E - 215.00 feet to a cedar post found at a fence corner on the
southeast line of the said 31.66 acre tract at the most westerly corner of that 7.69 acre
tract conveyed to the City of College Station, Texas, by deed recorded in Volume 379,
Page 81 of the Deed Records of Brazos County, Texas;
Thence N 41° 51' 40' E - 414.82 feet along the southeast line of the said 31.66 acre tract
and the northwest line of the said 7.69 acre tract to an iron rod set at the most northerly
corner of the said 7.69 acre tract, said point also being the most westerly corner of Lot 1
Block 'C' of the said Eastmark Subdivision Phase II addition;
Thence N 42' 22' 55' E - 15.72 feet continuing along the southeast line of the said 31.66
acre tract and the northwest line of Lot I Block 'C' of the said Eastmark Subdivision
Phase II addition to the Point of Beginning and containing 5.04 acres of land more or
less.
