HomeMy WebLinkAbout04-9-92-6.8 - Resolution - 04/09/1992RESOLUTION NO. 4-9-9 2-6.8 A RESOLUTION AUTHORIZING THE MAYOR, CITY MANAGER AND CITY ATTORNEY TO ACQUIRE A 0%206 ACRE TRACT IN THE CRAW- FORD BURNETT SURVEY FOR USE AS A PARK FOR THE LINCOLN CENTER/WAYNE SMITH PARK CORRIDORMASTER PLAN. WHEREAS, the City of College Station having determined the necessity of acquiring a 0.206 acre tract for use as a park for the Lincoln Center/Wayne Smith Park Corridor Master Plan; and WHEREAS, the City Council having determined that it is necessary to acquire the tract of land attached to this Resolution, and that the public need requires the acquisition of same in such manner as to make the property available for lawful use for such purpose; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of College Station that the property described in Exhibit A attached hereto shall be acquired by the City; and the reasonable cash market value of same shall be determined and paid according to law, either by voluntary purchase or by condemnation; and that the City Manager, the Mayor, and the City Attorney are authorized to take any and all necessary actions to obtain and pay for such property, including the marketable fee simple title thereto, free and clear of any restrictions or covenants inconsistent with the use of same for all lawful purpose. Further, that the City Attorney is by this resolution expressly authorized to initiate and pursue condemnation proceedings and any other necessary litigation incident to the purpose herein set forth. PASSED AND APPROVED this 9th day of April 1992 EST: City Secretary APPROVED: EXHIBIT All that 0.206 acre tract or parcel of land lying and being situated in the Crawford Burnett Survey, A-7, in Brazos County, Texas, and described as follows: BEGINNING at a stake set on the Southwest line of the extension of Eleanor Street, which state is N 45 W 400 feet from the North corner of a tract of land conveyed by Edward Hrdlicka et ux to A&M Colored consolidated school; THENCE N 45 W with the Southwest line of the extension of said Eleanor Street, a distance of sixty feet and corner a stake set for the North corner of this lot; THENCE S 45 W 150 feet and corner a stake for corner; THENCE S 45 E 60 feet and corner a stake for corner; THENCE N 45 E 150 feet to the place of beginning, containing a lot 60 feet in width and 150 feet in length, and being the same tract described in a Warranty Deed from Edward V. Hrdlicka et us to Thelma Walker on May 25, 1949, as recorded in Volume 139, Page 387 of the Deed Records of Brazos County, Texas.
