NOE COLLEGE STATION Council Members BILL FOX LARRY MARIOTT DAVID HICKSON DICK BIRDWELL BRAD MARTIN MINUTES COLLEGE STATION CITY COUNCIL SPECIAL MEETING TUESDAY, NOVEMBER 19, 1996 5:30 p.m. COUNCILMEMBERS PRESENT: Mayor MclIhaney, Mayor Pro tem Kennady, Councilmembers Hickson, Fox, Birdweli, Mariott, Martin STAFF PRESENT: City Manager Noe, Assistant City Manager Brymer, City Planner Kee, City Secretary Hooks, Acting City Attorney Nemcik, City Engineer Laza City Manager Noe briefly summarized the location of the four tracts of acreage under consideration for annexation. The following information describes each tract. Area 1. Approximately 65 acres in front of the Nantucket Subdivision and approximately 48 acres of SH 6 right of way. Submitted by petition. Area 2. Approximately 1200 acres on the east side of SH 6 across from Nantucket, adjacent to Pebble Creek. Area 3. Approximately 200 acres on the west side of Wellborn Road along with approximately 26 acres of Wellborn Road right of way fronting these 200 acres. Area 4. Approximately 12.8 acres along Arrington Rd. to clarify a 1983 annexation consist of a 2.4 acre tract under private ownership containing a concrete batching plant and small appliance shop, a 3.8 acre tract owned by the City of CS containing an electrical substation an a 6.6 acre tract owned by the City of Bryan containing an electrical substation. Providing Customer Service Excellence Special Meeting Tuesday, November 19, 1996 Page 2 Mayor Pro tem Kennady raised questions about each area pertaining to noise level activity from Texas World Speedway and future implications of annexation for Nantucket Subdivision. Mayor McIlhaney opened the floor for public comment. O.D. Butler, of 700 Thomas spoke in opposition to the annexation of Area 3 on behalf of the Ellington's who own property in Area 3. Ms. Betty Ellington Schutte daughter of Verna Ellington, owner of Area 3, addressed the Council. She emphasized several reasons in opposition to the annexation. Her remarks related to the mention of future industrial development for this land. Edsel Jones, 3008 Durango addressed the Council. He asked council to defer consideration of annexing Area 3. Discussion was held on the proposed comprehensive land use plan. Councilman Martin made a motion to consider the proposed areas separately. The motion was seconded by Councilman Birdwell which did not pass by a vote of 3-4. FOR: Mayor Mcllhaney, Councilmembers Birdwell and Martin AGAINST: Mayor Pro tem Kennady, Councilmembers Fox, Hickson, Mariott Councilman Fox made a motion to approve Ordinance No. 2119 to annex the four areas prescribed by staff. Councilman Hickson seconded the motion. Councilman Birdwell conveyed his concems against the annexation proposals with respect to timing of development. He was not against the annexation proposal for Area 4. Councilmembers Fox and Kennady made remarks about the positive impact to the City upon annexation of this package. Councilman Kennady added that this annexation is necessary to secure electrical revenue fi.om newly annexed area, Mayor Mcllhaney expressed her support for annexations in Areas 1, 2, and 4. The motion carried by a vote 4-3 to approve all areas for annexation as submitted. A~enda Item No. 2 -- Discuss ordinance amending Section 7.22 C-B Business Commercial District in Ordinance 1638 allowing for limited outside business activity. Question was asked by Councilman Fox about the restriction on business activity in a parking lot in the new ordinance. Ms. Kee explained the staff's recommendation. Mayor Mcllhaney asked council to review the ordinance. Consideration of this item will be on the November 20th agenda.
