HomeMy WebLinkAbout10-22-98-8.7 - Resolution - 10/22/1998q so[ution RESOLUTION NO. 10-22-98-8.7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, PROVIDING FOR A POLICY ON CERTIFIED AGENDAS FOR EXECUTIVE SESSIONS FOR THE CITY COUNCIL AND CERTAIN OTHER BOARDS AND COMMISSIONS. WHEREAS, the City Council acts pursuant to the Open Meeting Act, Government Code, Chapter 551; and WHEREAS, the City Council of the City of College Station desires to establish a policy for certified agenda; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: PART 1: The City Council and any board or commission that is quasi-judicial or rulemaking shall develop a certified agenda on matters related to discussions held under two provisions of the Government Code § 551.072 Real Property, and § 551.074 Personnel. A certified agenda shall not be required for other items. PART 2: A certified agenda must contain the following items: (1) (2) (3) (4) A summary of the subject matter of each deliberation; A record of any further action taken; An announcement by the presiding officer at the beginning and the end of the closed meeting indicating the date and time; and Approved and signed by the presiding officer. PART 3: Any member of the City Council, board or commission member who participated in the executive session may view the certified agenda within ten business days following the closed meeting. Upon the signing of the certified agenda by the presidin.g officer, the document shall be sealed in an envelope and stored m a vault at the City Secretary's office. The certified agenda is not public information and may be opened only by court order. A~s established in the Records Retention Schedules for the City of College Station, certified agendas are retained for two years after the date of the session. Government Code § 551.104(a). PART 4: The City Council specifically finds and declares that no tape recording of a closed meeting will be allowed by council members, board or commission members or City staff Resolution No. 10-22-98-8.7 Page 2 PART 5: The City Council requests that the City Secretary keep the Council updated of any changes that need to be made to this Resolution. ADOPTED by the City Council of the City of College Station, Texas, this 22rd., day of October, A.D. 1998.
