RESOLUTION NUMBER 1-14-99-6.4C
RESOLUTION URGING THE TEXAS LEGISLATUIRE TO SUPPORT THE CONTINUED
REMITTANCE OF THE EMERGENCY SERVICE FEE TO THE COUNCILS OF GOVERkrMENT FOR
THE ADMI!krISTI:L~TION OF 9-1-1 SERVICES PROVIDED BY THE COUNCILS
WHEREiS, the City of College Station is a Regional Planning Commission organized
under provisions of Chapter 570, Acts, 59th Legislature, Regular Session, 1965 (Codified
as Article 101 lm, V.A.C.S.), and represents the seven county Brazos Valley region that
consists of Brazos, Bur]eson, Grimes, Leon, Madison, Robertson and Washington Counties;
and
WHEREAS, the implementation of 9-1-1 Emergency Services is a core function of
councils of government in the State of Texas; and
WHEREAS, Texas House Bill 911, signed into law on May 28, 1987, established the
funding structure to finance statewide 9-1-1 implementation as recommended by the
Advisory Commission on State Emergency Comm,mications; and
W~IEREAS, Texas House Bill 911, now Health and Safety Code, Chapter 771,
Subtitle B. - Emergencies, designated that Emergency Service Fees, levied on local
exchange telephone service, be remitted directly to the councils of governments in order to
implement regional 911 services; and
WITEREAS, Emergency Service Fees are local fees that should be directly remitted to
the councils of government for local use in the development and maintenance of the
regional 9-1-1 Emergency Communications System; and
WHEREAS, council of governments are held accountable for the utilization of local
9-1-1 funds through their five-year strategic plan and two-year operational plan as
recommended by the 9-1-1 Regional Advisory Committee and approved by the City of
College Station Council; and
WHEREAS, the strategic and operational plan is submitted to the Advisory
Commission on State Emergency Communications for the final approval and updated
annually; and
WHEREAS, the Texas Sunset Advisory Comra~ssion has recommended that all
Emergency Fees are to be deposited in a dedicated account in the State Treasury and
subjected to the legislative appropriations process; and
NOW, THEREFORE, be it resolved by the City of College Station Council;
THAT THE 76th Legislature be and hereby is urged to maintain the current funding
structure of statewide 9-1-1 services as established in Texas House Bill 911 thereby
continuing the direct remittance of the local Emergency Services Fees to the councils of
governments and ensuring local e.~tr~rdstration of local funds to be expended for regional
9-1-1 services as set forth in each region's strategic and operational plans.
THAT a copy of this resolution be transmitted to the offices of the Governor,
Lieutenant Governor, Speaker of the House of Representatives, the Chairman of the Texas
Transportation Commission smd the chairs of the following legislative committees: Senate
Committee on Finance, Senate Committee on State Affairs, house Committee on
Appropriations, House Committee on Transportation, House Committee on Ways and
Means, and House Select Committee on Revemue and Public Education Funding.
