AN ORDINANCE VACATING AND ABANDONING A PORTION OF A PUBLIC UTIL-
ITY EASEMENT IN THE S.W. ROBERTSON SURVEY IN BRAZOS COUNTY,
TEXAS, THROUGH THAT 956.10 ACRE TRACT OWNED BY W.D. FITCH, BEING
A PART OF A TWENTY FOOT UTILITY EASEMENT, AND BEING MORE PARTICU-
LARLY DESCRIBED ON EXHIBIT "A" ATTACHED HERETO.
WHEREAS, on January 2, 1985, W. D. Fitch conveyed to the City of
College Station a utility easement across the property described
in the attached Exhibit "A" and that easement was later dis-
covered to be in a creekbed; and
WHEREAS, the City of College Station is desirous of relocatinq
the easement across the property described in the attached
Exhibit "B," and W. D. Fitch has agreed to convey a utility
easement across the property described in Exhibit "B" for and in
consideration of the abandonment of the easement across the prop-
erty described in Exhibit "A."
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF COLLEGE
STATION, TEXAS:
For and in consideration of the conveyance of an easement across
the property described in the attached Exhibit "B," the City
Council of the City of College Station hereby authorize the Mayor
and City Secretary to abandon the easement across the property
described in the attached Exhibit "A."

EASEMENT NO. 6
C.gmmenclng at an iron rod found at the Intersection of the
northeast line of State Highway No. 6 and the southeast line of
Greens Prairie Road, which is the most westerly corner of the
said W.D. Fitch 956.10 acre tract.
Thence S 49 degrees 22' [2" E - 2007.0 feet along the northeast
line of State Highway No. 6 to a concrete right-of-way marker;
Thence S 47 degrees 09' 13" E - 465.3 feet continuing along the
northeast line of State Highway No. 6 to a concrete right-of-way
marker;
Thence S 42 degrees 24' 38" E - 175.8 feet continuing along the
northeast line of State Highway NO. 6 to the Point of Beginning
of this easement;
Thence N 54 degrees 17' 54" E - 135.8 feet through the said W.D.
Fitch 956.10 acre tract to the end of this easement.

Being a strip of land in the S.W. Robertson Survey in Brazos County,
Texas, twenty (20') feet in width through that 956.10 acre tract
conveyed to W.D. Fitch by deed recorded in Volume 703, Page 8 of the
Deed Records of Brazoe County, Texas, and lying ten (10') feet each
side of the following described centerlinee:

Beginning in the northwest line of the said W.D. Fitch tract which ie
also the southeast line of Greens Prairie Read, at a point located N
43 degrees 04' 02" E - 376.2 feet from an iron rod found at the most
westerly corner of the said W.D. Fitch tract.

956.10 acre tract to the end of this easement.

Beginning in the northeast line of State Highway No. 6, S 49 degrees
22' 12" E - 1389.9 feet from an iron rod found at the most westerly
corner of the said W.D. Fitch 956.10 acre tract.
Thence N 29 degrees 01' 08" E - 157.7 feet through the said W.D. Fitch
956.10 acre tract to the end of this easement.
