HomeMy WebLinkAbout2-13-2003-9.2 - Resolution - 02/13/2003RESOLUTION NO. 2-13-2003-9.2 A JOINT RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, AND THE BOARD OF TRUSTEES OF THE COLLEGE STATION INDEPENDENT SCHOOL DISTRICT ORDERING ELECTIONS TO BE HELD IN SAID CITY AND SCHOOL DISTRICT ON MAY 3, 2003; FOR THE PURPOSE OF ELECTING PLACES 1, 3, AND 5 ON THE COLLEGE STATION CITY COUNCIL, AND POSITIONS 1 AND 2 ON THE BOARD OF TRUSTEES OF THE COLLEGE STATION INDEPENDENT SCHOOL DISTRICT; AND PROVIDING PROCEDURES RELATING TO THE CONDUCT OF SAID ELECTIONS. WHEREAS, it is necessary to hold an election in the City of College Station, Texas, to elect persons to fill the positions of Places 1, 3 and 5 on the City Council of the City of College Station, Texas; and WHEREAS, it is necessary to hold an election within the College Station Independent School District to fill the positions of Places 1 and 2 on the Board of Trustees of the College Station Independent School District; and WHEREAS, the City and College Station Independent School District will hold elections on the same day; to-wit: May 3, 2003; and WHEREAS, Section 271.002 of the TExAS E1,ECTIoN CovE authorizes more than one political subdivision to hold joint elections; and WHEREAS, the City Council of the City of College Station, Texas, and the Board of Trustees of the College Station Independent School District deem it to be in the best interest of their respective subdivisions and in the interest of the voters who reside within their respective jurisdictions to hold such elections jointly; now, therefore, BE IT JOINTLY RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, AND THE BOARD OF TRUSTEES OF THE COLLEGE STATION INDEPENDENT SCHOOL DISTRICT: PART l: That joint elections be, and the same are hereby ordered to be, held within the jurisdictions of the City of College Station, Texas, and the College Station Independent School District, on the 3rd day of May, 2003, pursuant to the laws of the State of Texas and the Charter of the City of College Station, Texas. Such elections shall be held for the following purposes: A. To fill the positions of Places 1, 3, and 5 on the College Station City Council. B. To fill the positions of Places 1 and 2 on the Board of Trustees of the College Station Independent School District. P/group/agen-cal/for legal review/1-13-03/jointresolutionorder2003.doc Resolution No. 2-13-2003-9.2 Page 2 PART 2: That there shall be one ballot that contains all appropriate races and propositions available for qualified voters of the two entities. PART 3: That said elections shall be held in accordance with the Constitution and laws of the State of Texas and the City Charter, and all duly qualified voters of the City of College Station shall be entitled to vote; provided, however, that no voter shall be given a ballot containing any office or proposition on which the voter is ineligible to vote. PART 4: That the election forms and records shall be combined in a manner convenient and adequate to record and report the results of the election for the City of College Station and the College Station Independent School District. The joint tabulation of the precinct results shall be in a manner to facilitate the independent canvass of returns by both entities. PART 5: That the implementation and management of said elections shall be by the City Secretary, City of College Station. The City Secretary, City of College Station, is hereby designated as the Chief Election Official and Early Voting Clerk for the two entities for the election to be held on May 3, 2003. The implementation, conduct and management of the elections shall include, but not be limited to: A. The securing of qualified individuals to serve as election judges for each polling place within a voting precinct. B. The securing of locations and facilities where the election is to be conducted. C. The securing of election materials and supplies requisite to the proper administration of the elections, and the programming and preparation of Direct Recording voting equipment to be used in the election. D. The securing of a contract with Texas Voting Systems, Inc., for election services and supplies. E. City shall be responsible for conducting early voting for said elections. F. City shall serve as general custodian of election records in the joint election. PART 6: Election expenses incurred as the result of the services rendered by the City in the May 3, 2003, election shall be apportioned as follows: A. The City will first fund all costs in full, other than the publication of each entity's Notice of Election. College Station Independent School District will reimburse the City for certain costs as follows: (a) one hundred percent (100%) of all costs incurred for polling places, election workers, and other expenses associated with polling locations outside the City limits of College Station. (b) one-half (1/2) of the cost of early voting. (c) one-half (1/2) of the cost of publication of all jointly required notices. (d) one-half (1/2) of the cost of programming, rental of DRE voting equipment for joint precincts, election supplies, election worker training session, Early Ballot Board, Central Counting Station, and the tabulation supervisor and data processing manager. PART 7: Each entity shall be responsible for any necessary submissions to the U.S. Department of Justice for preclearance under the Federal Voting Rights Act. The period for early voting shall be April 16, 2003, through Apri129, 2003. Applications for ballot by mail shall be available beginning March 4, 2003, and last day to receive application by mail is April 25, 2003. The Early Voting Clerk for said elections shall be the City Secretary. She shall appoint city employees and additional assistance by qualified individuals of the community to serve as deputy early voting clerks to assist her at the early voting polling places. The Election Coordinator for the College Station Independent School District shall serve as Deputy Early Voting Clerk in said elections. The main early voting polling place by personal appearance shall be in the City Hall Training Room, 1101 Texas P/group/agen-cal/for legal review/2-13-03/jointresolutionorder2003.doc Resolution No. 2-13-2003-9.2 Page 5 Avenue, College Station, Texas. Two branch early voting locations shall be designated for these elections. Main Early Voting Location: College Station City Hall 1101 Texas Avenue College Station, Texas 8:00 a.m. to 5:00 p.m. (M-F) Branch Location: College Station School District Administration Bldg. 1812 Welsh College Station, Texas 8:00 a.m. to 5:00 p.m. (M-F) Branch Location: Post Oak Mall 1500 Harvey Road College Station, Texas 10:00 a.m. to 9:00 p.m. (M-F) PART 10: Each entity shall be responsible for any necessary submissions to the U.S. Department of Justice for preclearance under the Federal Voting Rights Act and giving notice of their election in a newspaper of general circulation. PART 11: The City Manager or his designee is hereby authorized to negotiate and execute an election services contract with Texas Voting Systems for services in connection with the joint election with the City of College Station and College Station Independent School District. PART 12: In accordance with Section 123.001 Of tlle TEXAS ELECTION CODE, the Hart Intercivic Direct Recording Electronic Voting System, Optical Scan Voting System and Electronic Management System for Brazos County, Texas, and approved by the Secretary of State on January 3, 2002, and identified as eSLATE is hereby adopted for this election. PART 13: Elections called by this joint resolution shall be held in accordance with the requirements for bilingual elections as set forth in the Voting Rights Act amendments for 1975 (42USC 1973aa-la) and in Section 272.001 of the Election Code. All election forms and material shall be printed in both English and Spanish, and bilingual oral assistance shall be made available within the requirements of the law. PART 14: The Mayor of the City of College Station is hereby authorized to sign an official NOTICE OF GENERAL ELECTION listing the precincts and polling place locations for the joint election. CONSIDERANDO QUE, es necesario llevar a cabo elecciones en la Ciudad de College Station, Texas, para elegir personas para llenar las posiciones de los Lugares 1, 3 y 5 del Consejo Municipal de la Ciudad de College Station, Texas; y CONSIDERANDO QUE, es necesario llevar a cabo una eleccibn dentro del Distrito Escolar Independiente de College Station para llenar las Posiciones de los Lugares 1 y 2 en el Consejo Directivo del Distrito Escolar Independiente; y CONSIDERANDO QUE, la Ciudad de College Station y el Distrito Escolar Independiente conducira las elecciones el mismo dia; siendo: e13 de Mayo, 2003; y CONSIDERANDO QUE, la Seccion 271.002 del CODIGO ELECTORAL DE TEXAS autoriza que mas que una subdivision politica lleve a cabo elecciones en conjunto; y CONSIDERANDO QUE, el Consejo Municipal de la Ciudad de College Station, Texas, y el Consejo Directivo del Distrito Escolar d Independiente de College Station decidieron que es del mayor interes de sus respectivas subdivisiones y del interes de los votantes que residen dentro de sus respectivas jurisdicciones llevar a cabo dichas elecciones en conjunto; ahora, entonces, SIENDO RESUELTO CONJUNTAMENTE POR EL CONSEJO MUNICIPAL DE LA CIUDAD DE COLLEGE STATION, TEXAS, Y EL CONSEJO DIRECTIVO DEL DISTRITO ESCOLAR 1NDEPENDIENTE DE COLLEGE STATION: PARTE 1: Que las elecciones conjuntas seran, y las mismas estan ordenadas a ser llevadas a cabo dentro de las jurisdicciones de la Ciudad de College Station, Texas, y el Distrito Escolar Independiente de College Station, el 3er dia de Mayo, 2003, bajo las leyes del Estado de Texas y el Estatuto de la Ciudad de College Station, Texas. Dichas elecciones se llevaran a cabo con los siguientes propositos: A. Para llenar las posiciones de los Lugares 1, 3, y 5 del Consejo Municipal de College Station. B. Para llenar las posiciones de los Lugares 1 y 2 del Consejo Directivo del Distrito Escolar Independiente de College Station. PARTE 3: Que dichas elecciones se llevaran a cabo de acuerdo con la Constitucibn y las leyes del Estado de Texas y el Estatuto de la Ciudad, y que a todos los votantes calificados de la Ciudad de College Station se le permitira votar; dado que, sin embargo, a ningun votante se le dara una boleta conteniendo ninguna oficina o proposicion para la cual el votante no esta calificado para votar. PARTE 4: Que los formularios y documentos de eleccion seran combinados en una manera conveniente y adecuada para el registro y reporte de los resultados de la eleccion para la Ciudad de College Station y el Distrito Escolar Independiente de College Station. El conteo en conjunto de los resultados de los precintos debera ser en una manera que facilite la aprobacion de los resultados por las dos entidades. PARTE 5: Que la implementacion y el manejo de dicha eleccion sera por la Secretaria Municipal, Ciudad de College Station. La Secretaria Municipal, Ciudad de College Station, esta designada como la Oficial Electoral Principal y Oficial de Votacion Anticipada para las dos entidades para la eleccion que se llevara a cabo el 3 de Mayo, 2003. La implementacion, conducta y manejo de las elecciones incluira, pero no esta limitada a: A. Asegurarse de conseguir individuos calificados para servir como jueces electorales para cada lugar de votacion adentro de cada precinto electoral. B. Asegurarse de conseguir los locales y las instalaciones en las cuales seran conducidas las elecciones. C. Asegurarse de conseguir los materiales y suministros requeridos para la administracion correcta de las elecciones, y la programacion y preparacion del equipo de votacion de Registro Directo utilizada en la eleccion. D. Asegurarse de conseguir el contrato con Texas Voting Systems, Inc., para los servicios y suministros para la eleccion. E. La Ciudad sera responsable de conducir las votaciones anticipadas para dicha eleccion. F. La Ciudad servira como el almacenador general de los registros electorales en dicha eleccion conjunta. La Ciudad reembolsara todos los gastos por completo, menos la publicacion de la Notificacion de Eleccion de cada entidad. B. El Distrito Escolar Independiente de College Station reembolsara a la Ciudad por ciertos gastos como los siguientes: (a) el cien por ciento (100%) de todos los costos de los lugares de votacion, trabajadores electorales, y otros gastos asociados con los lugares de votaci6n fuera de los limites Municipales de College Station. PARTE 7: Cada entidad debe ser responsable por cualquier envio necesario al Departamento de Justicia de los Estados Unidos para la previa aprobacion segun el Acto Federal de los Derechos de los Votantes. Las solicitudes por correo estaran disponibles comenzando e14 de Marzo, 2003 y el ultimo dia para recibir solicitudes por correo es el 25 de Abril, 2003. Ella designara empleados municipales y obtendra la asistencia de otros individuos de la comunidad calificados como diputados de votacibn anticipada para asistirla en los lugares de votacion anticipada. La Asistente Ejecutiva al Superintendente del Distrito Escolar de College Station servira como Secretaria Diputada de Votacion Anticipada de dicha eleccion. El lugar principal para la votacion anticipada sera el Salon de Entrenamiento del Edificio Municipal, 1101 Texas Avenue, College Station, Texas. Dos lugares adicionales de votacion anticipada seran designados para estas elecciones. PARTE 11: El Gerente Municipal o su designado esta autorizado para negociar y ejecutar un contrato de servicios electorales con Texas Voting Systems para los servicios relacionados con la eleccion conjunta de la Ciudad de College Station y el Distrito Escolar Independiente de College Station. PARTE 12: De acuerdo con la Seccion 123.001 del Cbdigo Electoral, los sistemas "Hart Intercivic Direct Recording Electronic Voting System", "Optical Scan Voting System" y"Electronic Management System" para el Condado de Brazos, Texas, y aprobada por el Secretario de Estado el 3 de Enero, 2002, e identificado como eSLATE esta debidamente adoptado para esta eleccion. PARTE 13: Las elecciones siendo ordenadas por esta resolucion conjunta seran conducidas de acuerdo con los requerimientos de elecciones bilingues como esta prescrito en las enmiendas de 1975 (42USC 1973aa-la) del Acta de los Derechos de Votacion y en la Seccibn 272.001 del Codigo Electoral. Todos los formularios electorales y materiales seran impresos en Ingles y Espanol, y asistencia oral bilingue estara disponible bajo los requerimientos de la ley. Una copia de la NOTIFICACION DE ELECCION GENERAL, cuando sea publicada en un peribdico de circulacion general en la Ciudad de College Station, servira como notificacion adecuada de la elecci6n ordenada por este Decreto Municipal.
