A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS, AUTHORIZING AN AMENDMENT TO THE RESOLUTION DETERMINING
NEED NUMBER 7-22-2002-11.11 BY MODIFYING THE DESCRIPTION OF SEVERAL
PROPERTIES IN THE PROJECT, AUTHORIZING THE ACQUISITION OF ADDITIONAL
PROPERTIES TO THE PROJECT AND DELETING THE DESCRIPTION OF SEVERAL
PROPERTIES FROM THE PROJECT.
WHEREAS, the City Council of College Station, Texas authorized a Resolution Determining
Need on July 22, 2002, said resolution being numbered 7-22-2002-11.11; and
WHEREAS, the description of several properties identified in the resolution have been modified,
the description of several properties not identified in the resolution have been added and the
description of several properties identified in the resolution have been deleted; and
WHEREAS, the public welfare and convenience will be served by the acquisition of an
exclusive public utility easement interest in said properties that were modified and added, and
there is not currently a public need for acquiring the properties identified for deletion;
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
COLLEGE STATION, TEXAS:
Part 1: That the Resolution Determining Need numbered 7-22-2002-11.11 dated July
22, 2002 is amended by modifying the description of the several of the
properties and by authorizing the acquisition of additional properties required
for the Parallel Water Line Project.
Part 2: That the Resolution Determining Need numbered 7-22-2002-11.11 dated July
22, 2002 is amended by deleting the description of several properties that will
not be required for the Parallel Water Line Project.
Part 3: That Exhibit "A", which is attached hereto and made a part hereof for all
intents and purposes, identifies and describes those properties to be modified,
deleted or added.
Part 4: That all other matters in the Resolution Determining Need numbered 7-22-
2002-11.11 dated July 22, 2002, including but not limited to the description of
the properties identified as Tracts 11 through 28, shall remain unchanged.
Part 5: That this resolution shall take effect immediately from and after its passage.

League, Abstract No. 45, in Bryan, Brazos County, Texas, being a part of that 51.984
acre tract conveyed to the Braver Corporation, Inc. by R.A. Galindo, Trustee as recorded
in Volume 436, Page 452 of the Deed Records of Brazos County, Texas, and being part
of that 17.359 acre tract conveyed to R. Coke Mills, trustee by deed recorded in Volume
1215, Page 232 of the Official Public Records of Brazos County, Texas.
Tract 6
All that certain tract or parcel of land lying and being situated in the Zeno Phillips
League, Abstract No. 45, in Bryan, Brazos County, Texas, being a part of that tract
conveyed to M.F. Thurmond, et al, by Lee Smith, et ux by deed recorded in Volume 205,
Page 306 of the Deed Records of Brazos County, Texas, and being the 11.91 acre tract
conveyed to Southwest Premier Properties, LLC by deed recorded in Volume 3192, Page
310 of the Official Public Records of Brazos County, Texas.
Tract 10
All that certain tract or parcel of land lying and being situated in the Zeno Phillips
League, Abstract No. 45, in Bryan, Brazos County, Texas, being a part of that 94.36 acre
tract conveyed to KKJM Investments Limited Partnership, a Texas Limited Partnership
by deeds recorded in Volume 3673, Page 105, and Volume 3237, Page 309 of the Official
Public Records of Brazos County, Texas.

Tract R2
Being a part of Lot 1 and Lot 2 of the Walter A. Etie, Jr. Subdivision according to plat of
record in Volume 2092, Page 140 of the Official Public Records of Brazos County,
Texas.

Being a part of Lot 14 in Block Four, Lots 7 and 10 in Block Two and the Parkland

Being a part of Lot 1 Block A of Discovery Subdivision according to plat of record in
Volume 597, Page 861 of the Deed Records of Brazos County, Texas.
Tract R6
All that certain tract or parcel of land lying and being situated in the Zeno Phillips
League, Abstract No. 45, in Bryan, Brazos County, Texas, being a part of the R.R.
Knowles 60 acre tract described in Volume 203, Page 543 of the Deed Records of Brazos
County, Texas, and being that 6.00 acre tract conveyed to Johnny Foster Lyon by deed
