RESOLUTION NO. 9 -12- 2002 -11.14
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS, DETERMINING A PUBLIC NECESSITY TO ACQUIRE A FEE SIMPLE
INTEREST IN CERTAIN PROPERTY; GIVING NOTICE OF AN OFFICIAL
DETERMINATION TO ACQUIRE A FEE SIMPLE INTEREST IN PROPERTY FOR THE
WELL NUMBER SEVEN PROJECT; AND ESTABLISHING PROCEDURES FOR THE
ACQUISITION OF A FEE SIMPLE INTEREST IN THE PROPERTY.
WHEREAS, it is necessary to establish procedures for determining the establishment and
approval of just compensation for the parcel in which to acquire a fee simple interest on which to
locate a water well, water lines, connecting lines, access facilities, communications lines and
other related facilities for the Well Number Seven Project; and
WHEREAS, there may be improvements located on some of the real property in which a fee
simple interest is acquired for this Project, and such improvements may be required to be moved
or demolished prior to the beginning of the Project; now, therefore,
BE IT RESOLVED by the City Council of the City of College Station, Texas:
PART 1: That the City Council of the City of College Station, Texas, hereby officially
determines that there is a public necessity for the Well Number Seven Project, and the
public welfare and convenience will be served by the acquisition of a fee simple
interest in the property referenced in Exhibit "A" attached hereto and made a part
hereof for all purposes as part of the Well Number Seven Project, for the purpose
increasing City water production.
PART 2: That the City Manager is hereby authorized to contract, on behalf of the City of
College Station, with a professional appraiser for the appraisal services, with a
professional real estate agent to act as a land agent for the City and with attorneys for
preparation of title opinions needed by the City from time to time in connection with
acquisition of a fee simple interest in property for the Well Number Seven Project.
PART 3: That the City's Land Agent or other staff appraiser is hereby authorized and directed
to examine the independent appraisal reports as they are submitted to said City to
determine whether said appraisal reports are supported by sufficient data. Based
upon such examination of said appraisal reports, the Land Agent or other appraiser
shall make a recommendation to the City Manager as to the establishment and
approval of the amount of the just compensation for a fee simple interest in said
parcel.
PART 4: After consideration of said recommendation, the City Manager shall establish and
approve the amount determined for acquisition of a fee simple interest in the parcel.
PART 5: Upon establishment and approval by the City Manager of the amount of just
compensation for the acquisition of a fee simple interest, the City's Land Agent is
authorized to communicate a written offer to the owners of said parcel for the
acquisition of a fee simple interest in said parcel at the full amount determined and
established to be just compensation therefore and to negotiate with said owners on
behalf of the City.

PART 6: That the Mayor after approval by City Council is hereby authorized to execute all
documents necessary to acquire a fee simple interest in each of the parcel needed for
said Project, on behalf of the City of College Station.
PART 7: That the City Manager be and is hereby authorized to sell any such surplus
improvements, or order the demolition thereof, if any, located on the real property
acquired in connection with this Project.
PART 8: That this resolution shall take effect immediately from and after its passage.

in deed from William J. Holler to the Most Rev. John E. McCarthy, Bishop of the Roman Catholic Diocese of
Austin, Texas, of record in Volume 3801, Page 293, Official Records of Brazos County, Texas, said 2.509
acre tract being more particularly described by metes and bounds as follows:
BEGINNING at a' /z" Iron Rod set in the northwest right -of -way line of OSR for the most northerly
corner, said corner being the calculated most northerly corner of said Called 53.14 acre tract and
also being a southeast corner of the Lucille Higgs Wehrman Called 13.86 acre tract as described
in Volume 279, Page 357;
THENCE S 19 ° 29' 29 " W, along the southeast line of said Called 53.14 acre tract and the
northwest right -of -way line of said OSR a distance of 353.97 feet to a' /2' Iron Rod set for the
""'` calculated point of curvature of said Called 53.14 acre tract;
THENCE continuing along the southeast line of said Called 53.14 acre tract and the northwest
right -of -way line of said OSR around a curve in a clockwise direction having a delta angle of
01 ° 25 ' 18 ", an arc distance of 140.69 feet, a radius of 5669.58 feet, and a chord of
S 20 ° 12 ' 08 " W, a distance of 140.68 feet to a ' /z' Iron Rod set for the southeast corner, said
corner being S 24 ° 33 ' 39 " W a distance of 721.41 feet from a Iron Rod set for the point of
tangency of said curve;
THENCE N 69 ° 05' 12 " W, a distance of 222.15 feet to a'/" Iron Rod set for angle point;
THENCE N 21 ° 46 ' 45 " W, a distance of 220.00 feet to a Iron Rod set in the northwest line of
said Called 53.14 acre tract and the southeast line of said Called 13.86 acre tract for the most
westerly corner, a 1" Iron Pipe found for the most southerly corner of said Called 13.86 acre tract
