A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS, AUTHORIZING THE MAYOR TO SIGN A STANDARD UTILITY AGREEMENT,
UTILITY JOINT USE AGREEMENT, STATEMENT COVERING CONTRACT WORK AND
AFFIDAVIT, AS REQUIRED TO OBTAIN STATE REIMBURSEMENT FOR THE
RELOCATION COST FOR AN 16" SEWER LINE TO FACILITATE THE CONSTRUCTION
OF U -TURNS ON SH6 AT THE HARVEY ROAD INTERCHANGE.
WHEREAS, the State of Texas, acting by and through the Texas Department of Transportation
(hereinafter referred to as "TxDOT "), proposes to make certain highway improvements generally
described as the relocation cost for an 16" sewer line to facilitate the construction of U -turns on
SH6 at the Harvey Road interchange; and
WHEREAS, the City of College Station retains a utility easement over property that falls within
the proposed highway right -of -way, the purpose of such easement being the location of utility
facilities; and
WHEREAS, the proposed highway improvements will necessitate the relocation of said sewer
line; and
WHEREAS, TxDOT, pursuant to TEXAS ADMINISTRATIVE CODE, Title 43, Chapter 21,
Subchapter B, may reimburse to the City of College Station the cost for relocation of utility
41110 facilities on a state highway system in accordance with a written agreement between the State
and the City; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:
That the Mayor is authorized to sign a Standard Utility Agreement, Utility Joint Use Agreement,
Statement Covering Contract Work and Affidavit, as required to obtain state reimbursement for
the relocation cost for an 16" sewer line to facilitate the construction of U -turns on SH6 at the
Harvey Road interchange.
ADOPTED this 8th day of August, A.D. 2002.
