AMENDING RESOLUTION NO. 9-23-00-12.17
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS, AMENDING RESOLUTION NO. 9-23-00-12.17 DETERMINING A PUBLIC
NECESSITY TO ACQUIRE AN INTEREST IN CERTAIN PROPERTY TO WAIVE STREET
PAVING ASSESSMENTS ON THE PROJECT.
WHEREAS, the City Council of the City of College Station adopted Resolution No. 9-23-00-
12.17 on September 23, 1999, to authorize the acquisition of property for the Rock Prairie Road
Extension Project; and
WHEREAS, Part 4 of the Resolution authorized the City Manager to waive assessments against
the property abutting the roadway in exchange for the dedication of the necessary property for
the extension &the roadway; and
WHEREAS, the property owners are unwilling to dedicate the property in exchange for an
assessment waiver; and
WHEREAS, the City Manager has determined that paving assessments for the project should be
waived because the enhancement to the property from the project is small and the administrative
cost and expense of levying the assessments on this project are infeasible and because it will
facilitate the acquisition of property; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:
That Part 4 of Resolution No. 9-23-00-12.17 is hereby amended to authorize the City Manager to
waive paving assessments against parcels abutting the roadway from which any portion of said
parcel is needed by the City for the right-of-way in addition to paying just compensation to the
property owners.
That this resolution shall take effect immediately from and after its passage.
