HomeMy WebLinkAbout8-8-2005-12.18 - Resolution - 08/08/2005 RESOLUTION NO 8 -8- 2005 -12.18 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, APPROVING A SEVERANCE PACKAGE FOR FORMER CITY MANAGER THOMAS E. BRYMER IN THE AMOUNT OF $177,585.40; APPROVING A COMPROMISE, SETTLEMENT AND MUTUAL RELEASE AGREEMENT WITH THOMAS E. BRYMER; AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT; AND AUTHORIZING THE EXPENDITURE OF FUNDS. WHEREAS, Thomas E. Brymer tendered his resignation from his position as City Manager of the City of College Station effective July 29, 2005, and the City Council of the City of College Station has accepted Mr. Brymer's resignation; and WHEREAS, the City and Mr. Brymer agree that it is in the best interest of Mr. Brymer and the City to resolve any claims each has or may have in the future against the other arising out of, or in connection with, Mr. Brymer's employment with the City and his separation thereof, and wish to enter into a Compromise, Settlement and Mutual Release Agreement to release such claims; and WHEREAS, the City Council agrees to provide to Mr. Brymer nine (9) months of his 2005 base salary and benefits; as set out with more particularity in the above - referenced Compromise, Settlement and Mutual Release Agreement; now, therefore, BE IT RESOLVED by the City Council of the City of College Station, Texas: PART 1: That the City Council hereby approves a severance package for Thomas E. Brymer that includes nine (9) months of 2005 base salary and benefits as set out with more particularity in a Compromise, Settlement and Release Agreement. PART 2: That the City Council hereby approves the Compromise, Settlement and Release Agreement and authorizes the Mayor to sign said Agreement. PART 3: That the City Council hereby authorizes the expenditure of a total amount of $202,235.75, to consist of $177,585.40 to Thomas E. Brymer in payment of the severance package pursuant to the terms of the Compromise, Settlement and Release Agreement; and $24,650.35 to be paid by the City for costs associated with Medicare, Workers Compensation, Retirement, and other additional costs related to the severance package. PART 4: That the City Council approves a contingency transfer in the amount of $100,000.00 and a budget transfer in the amount of $102,235.75 into the General Government Department, City Manager's Office Budget, to provide the budget appropriation for the severance package, and additional costs to the City related to the severance package, in the total amount of $202,235.75. PART 4: That this resolution shall take effect immediately from and after its passage. ADOPTED this 8 ay August, Au ust A.D. 2005.
