HomeMy WebLinkAbout01/23/1947 - Regular Minutes - City CouncilMINUTES OF POSTPONED MEETING January 23, 1947 Members present: Mayor Langford; Councilmen limes, Brown, Crawford, Orr, Wilcox; City Secretary McGinnis; and City M-nager Vaughn. Visitors present: Guy F. Boyett, Sr., Guy F. Boyett, Jr., and W. Lamar Fly. On motion of Councilman Wilcox, the Council renewed a lease with H; E. Burgess fo space for City offices, the lease to run from January 1, 1947 to December 31, 1948 at $65.00 per month. The Council voted to deposit all monies received from sale of bonds at the College Station State Bank. Such funds will bear interest one-half of one per cent.. On motion of Councilman Wilcox, seconded by Councilman Crawford, Ordinance No. 99 was approved. The application of Claude Bearden for rezoning of certain sections of the City was tabled for further consid-enation. The City Manager was instructed to notify the contractor that the streets i.,. the North Gate Area, excavated for sever installation, should be repaired immediately. On motion of Councilman Orr, seconded by Councilman Wilcox, the Council approved Ordinance No. 98, authorizing the issuance of cemetery warrents. Ordinance No. 96 was approved as follows; I ORDINANCE NO. 96. THE STATE OF TEXAS COUNTY OF BRAZOS CITY OF COLLEGE STATION On this the 23rd day of January, 1947, the City Council of the City of College Station, Texas, was convened in special session at the regular meeting place in the City Hall of s:.id City, with the following present, to wit: Ernest Langford, E. E. Ames ) C. `'4. Crawford ) G. B. Wilcox ) R. L. Bro�ln ) J. a. Orr ) N. M. McGinnis Mayor, Councilmen City Secretary and the following absent: 14. T. Harrington , constituting a quorum, when among other proceedings had were the following: Councilman Wilcox was read in full. introduced a proposed ordinance. The motion was seconded by Councilman Crawford Thb motion carried by the following vote: AYES: Councilmen Crawford , Wilcox , Ames , Brown , Orr, ; NOES: NONE. Councilman _Brown _ moved that the ordinance be passed finally. The motion was seconded by Councilman Ames . The motion carried by the following vote: AYES: Councilmen Crawford , Wilcox , Ames , Brown , Orr ; NOES: NONE. The Mayor announced that the ordinance had been finally passed. The ordinance is as follows: AN ORDINANCE AMENDING AN ORDINANCE BY THE CITY C6UNCIL OF THE CITY, OF COLLEGE STATION, TEXAS, AUTHORIZING THE ISSUANCE OF BONDS FOR THE PRINCIPAL SUM OF $85,000.00, FOR THE PURPOSE OF CONSTRUCTING IMPROVEMENTS AND EXTENSIONS TO THE WATERWORKS SYSTEM AND THE SANITARY SEVER SYSTEM OF SAID CITY4 AND PROVIDING FOR THE LEVY ASSESSMENT AND COLLECTION OF A TAX ON -ALL THE TAXABLE PROPERTY NITHIN THE LIMITS OF SAID CITY TO PAY THE INTEREST AND CREATE A SINKING FUND FOR THE RED-DUI'TION THEREOF; PRESCRIBING THE FORM OF BOND; AND DECLARING AN EMERGENCY. WHEREAS, heretofore, to .wit: on the 30th day of December, 1946, the City Council of the City of College Station adopted an ordinance authorizing the issuance of 685,000.00 CITY OF COLLEGE STATION WATERWORKS AND SEWER BONDS, SERIES 1947, dated January 1, 1947 Bonds Nos. 1 to 13, inclusive, bearing interest at the rate of 2% per annum, Bonds Nos. 14 to 55, inclusive, bearing interest at the rate of 2-3/4% per annum, and Bonds Nos. 56 to 85, inclusive, bearing interest at the rate of 3% per annum, interest payable March 1, 1948 and semi-annually thereafter on September 1st and March 1st in each year, and maturing on March lst in each of the years 1948 to 1967,.inclusive; and WHEREAS, the City Council of the City of College Station, Texas, now deems it advisable and to the best interest of s.id City that said ordinance adopted on the 30th day of December, 1946, be amended; THEREFORE, BE I7.ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, i TEXAS: 1. That Section III of the ordinance adopted by the City Council on the 30th day of December, 1D46,,authorizing the issuance of $85,000 CITY OF COLLEGE STATION WATERNORKS j,ND SEWER BONDS, SERIES 1947, dated January 1, 1947, be, and the same is hereby amended so as to read hereafter as follows: "III. That Section IV of said ordinance adopted on the 30th day of December, 1946, be and the same is hereby amended so as to read hereafter as follows: II Iv "That said bonds shall bear interest from date as follows: Bonds Numbers 1 to 13, inclusive, at the rate of two (2%) per cent per annum, Bonds Numbers 14 to 55, inclusive at the rate of two and three-fourths (2-3/4,%) per cent per annum, and Bonds Numbers 56 to 85, inclusive, at the rate of three (3%) per cent per annum; interest payable March 1, 1948 and semi-annually thereafter on September lst and March 1st in each year, except that the last interest payment date shall be January 1, 1967." 3. That the form of bond as set out in Section VIII of said ordinance adopted on December 30, 1946, be and the same is hereby amended so as to conform to the pro- visions of -this ordinance. 4.. That, except for the provisions herein contained, the ordinance adopted on : the 30th day of Decmber, 1946, shall remain in full force and effect. 5. The fact that the City of Colle"e Station, Texas, is badly in need of the improvements to its Waterworks System and Sanitary Sewer System, and said improvements will be to the best interest and general welfare of the said City creates an emergency and an imperative public necessity that the rule requiring ordinances to read at more than one meeting of the City Council before final passage be suspended, and said rule is hereby suspended, and that this ordinance take effect and be in full force and effect immediately from. and after its passage at this meeting, and it is so ordained.
