AN ORDINANCE ABANDONING THE BLANKET EASEMENTS RECORDED IN VOLUME
98, PAGE 226, AND VOLUME 98, PAGE 227, OF THE DEED RECORDS OF
BRAZOS COUNTY, TEXAS, AND RETAINING PLATTED EASEMENTS ON THE RE -
PLAT OF LOT Al AND LOT A2 OF THE RE -SUBDIVISION OF LOT A OF THE
D. A. SMITH SUBDIVISION.
WHEREAS, the City of College Station has inherited two easements
from the City of Bryan upon the takeover of electric utility ser-
vice to the property owned by Texas 707; and
WHEREAS, the City of College Station has by re -subdivision of Lot
A of the D. A. Smith Subdivision, originally recorded at Volume
529, Page 13, of the Deed Records of Brazos County, Texas, re-
ceived on Lot Al and Lot A2 designated easements, which easements
will be actually used in the re -development of the property; and
WHEREAS, it is the intent of the City Council to authorize the
Mayor to execute the Partial Abandonment and Re -designation of
Easements;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
COLLEGE STATION, TEXAS, that the Mayor is hereby authorized to
execute the Partial Abandonment and Re -designation of Easements
whereby the blanket easements recorded at Volume 98, Page 226, of
the Deed Records of Brazos County, Texas, and recorded in Volume
98, Page 227, of the Deed Records of Brazos County, Texas, will
be abandoned as to the remaining portions of Lots Al and A2 other
than the designated utility easements on the replat of the
re -subdivision of the Lot A of the D. A. Smith Subdivision,
Richard Carter League, Abstract No. 8, College Station, Brazos
County, Texas.

PARTIAL ABANDONMENT AND
REDESIGNATION OF FASEMENr
WHEREAS, Mr. and Mrs I C. Burkhalter by instrument dated
April 20, 1937, recorded in Volume 98, Pace 226, of the Deed Rec-
ords of Brazos County, Texas, granted a blanket right-of-way
easement to the City of Bryan, Texas (predecessor in title to the
City of College Station, Texas) on certain property lying in the
Richard Carter League, Brazos County, Texas; and
WHEREAS, Mr. and Mrs A L. R�sprim by instrument dated
April 23, 1937, recorded in Volume 9F, Pace 227 of the Deed Rec-
ords of Brazos County, Texas, gave a right-of-way easement to the
City of Bryan, re Ras (predecessor in title to the City of Lolleqe
Station, Texas) on certain property lying in the Ricnard Carter
League, Brazos County, Texas; and
WHEREAS, the easements granted in the above -described In-
struments were blanket easements encompassing the entire proper-
ties that are currently known as Lot Al and Lot A2, a resubdi-
vision of Lot A of the D A. Smith Subdivision. originally re-
corded in Volume 529, Page 13, ,f the Deed Records Df Braros
County, Texas and
WHEREAS, the neels of the City of College Station in regard
to utility easements for the nerviie nf this area have been de-
fined in the recent vacating and resubdividinq Lot A of the D.
A. Smith Subdivision of the Richard Carter League, Celletie Sta-
ticn, Brazos County, Texas; and
WHEREAS, said replat provides for a Lnt Al and a Lot A2 cen-
siating of 75,235 square feet; and
WHEREAS, said plat provides for the City of College Station
to have a twenty foot (20') utility easement along the southeast
side of lot AL and a fifteen foot (15') utility easement along
the northeast side of Lot A2; and
WHEREAS, it in the intent of the City of College Station and
the owners, Chalon Jones, E. W. Schultz, James A. Callaway, Don-

aid B. McCrory, and Charlie Light Callaway, doing business as
Texas 707, for the City of College Station to abandon the blanket
easements granted by the above -described right-of-way easements
executed by the Burkhalters and Rosprims as to the remaining
portion of Lot Al and A2 other than the fifteen foot (1S-)
utility easement and twenty foot (20') utility easement set Out
on the replat
NOW, THERF.PORE, in consideration of the above recitations,
the City of College SLetion hereby abandons the blanket easements
granted by the above -described right-of-way easements executed by
the Burkhalters and Rosprims is to the remaining portion of Lots
Al and A2 other than the fifteen foot (15') utility easement end
twenty foot (20') utilitv easement set vut on the replat.
