HomeMy WebLinkAbout1988-1759 - Ordinance - 06/09/1988ORDINANCE NO. 1759 AN ORDINANCE RECEIVING CERTAIN TERRITORY ADJOINING THE CITY LIM- ITS OF THE CITY OF COLLEGE STATION, TEXAS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STA- TION, TEXAS: WHEREAS, the City of College Station, the sole owner of the here- inafter described territory adjoining the limits of the City of College Station, Texas, has petitioned for annexation of its property and has stated by affidavit that there are no registered voters residing within the boundaries of the hereinafter de- scribed territory; and WHEREAS, the aforesaid affidavit has been filed with the City Secretary who has certified the same to the City Council; and WHEREAS, the Planning and Zoning Commission held a public hearing at City Hall at 7:00 p.m. on May 5, 1988, and the City Council held a public hearing in the City Hall at 7:00 p.m. on May 12, 1988, on the question of receiving certain territory into the city limits; NOW, THEREFORE, the City Council by virtue of the authority con- ferred by Article II, Section 6 of the Charter of the City of College Station, Texas, approved April 1, 1978, by this ordi- nance, does hereby receive such territory within the incorporated limits of the City of College Station, Texas, such territory being more particularly described as follows: Tract 1: All that certain 515.54 acre tract or parcel of land, lying and being situated in the S.W. Robertson League, Abstract No. 202, Brazos County, Texas, save and except that 17.8 acre tract owned by W.D. Fitch and Young Brothers, Inc., which tract was annexed by the City on October 13, 1983 by Ordinance No. 1461, and be- ing a portion of a called 1265.37 acre tract conveyed by Robert F. Spearman to the City of College Station, Texas, by deed recorded in Volume 488, Page 756 of the Deed Records of Brazos County, Texas, and being more particu- larly described by metes and bounds in the de- scription attached hereto and marked Exhibit "A". 005297 Tract 2: A 7.9 acre tract of land, in the S.W. Robertson Survey Abstract No. 202, Brazos Coun- ty, Texas, and being part of a 27.29 acre tract of parkland dedicated to the City of College Station by W.D. Fitch and Young Brothers, Inc., Contractors, described in deed in Volume 1029, Page 13 of the official records of Brazos Coun- ty, Texas, more particularly described by metes and bounds in the description attached hereto and marked Exhibit "B". The council further finds that it is in the best interest and to the benefit of the public to annex this area leaving a section outside of the city limits until a petition is received. Attached to and incorporated herein as a part of this ordinance is a service plan, marked Exhibit "C", providing for the exten- sion of municipal services into the duly described territory, said plan having been presented at the public hearing heretofore named and subsequently approved by the City Council of the City of College Station, Texas. WHEREAS, HB-1952 requires a plan of service be adopted by the governing body of a city prior to passago of an ordinance annexing an area. WHEREAS, the City of College Station is contemplating annexation of an area hounded as follows: SEE EXHIBIT "A" NOW, THEREFORE, HE: IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: Section 1. Pursuant to the ProvislonS of Article 970a, Vernon's Texas Civil Statutes, as amended by 1413-1952, there Q hereby adopted, for the area bounded as described in Exhibit "A", Lhp following Plan of service: a. Police (1) Patrolling, radi" responses to calls, and other routine police services, using present personnel and equipment, will be provided on the effective date of annexation. (2) Additional police personnel and patrol cars will be added to continue the present level of pnlive services throughout Lhe city, including the newly annexed areas as required. (3) Traffic signals, traffic signs, street markings, and other traffic_ rontrol devices will be installed as the need therefore is established by appropriate study and traffic standard,. b. Fire (1) No additional equipment or personnel will be required to serve the expanded City. C. Emergency Medical Service (1) No additional Pquipment or personnel will be required to serve the expanded City. d. Water 1 EXHIBIT "C" 0 0 5 Z 0 A (1) The water distribution system for this area will be instilled as described in "Exhibit "B". e. Sewers (1) The sanitary sewer collection system for this area is in place as described in "Exhibit "B". f. Electrical (1) Initial Electrical Ser✓ice to this area will he provided from the existing system within the City y. Refuse Collection (1) The same refuse collection service provided within the City will be provided in this area in accordance with the policy and ordinances of the City. h. .^,treets (1) Emergency maintenance of the existing streets (repair of hazardous chuck holes, measures necessary for traffic flow, etc.) will begin on the effective date of annexation. (2) Routine maintenance, on the same basis as within thr present City Limits, will begin on the effective date of annexation. (3) Construction, reconstruction and/or resurfacing of streets, installation of storm drainage facilities construction of curbs and gutters, and other such improvements will be made ae the need arises and in accordance with the policy and ordinances of the City. i. Inspection Services Any inspection services now provided by the City (building, electrical, plumbing, gas, housing, weights and measures, sanitation, etc.) will begin in the annexed area in accordance with the current City Code on the effective date of Annexation. 7. Planning and Zoning The Planning and Zoning jurisdiction of the City will extend to the annexed area on the effective date of annexation. City planning and zoning requirements will thereafter encompass the annexed area. All areas will be zoned A-n until permanent zoning classification] are established. k. Street bighting 2 005305 StrePL lights will be installed in substantially developed commercial and residential areas under the standards currently prevailing in the existing city and in accordance with the policies and ordinances of the rity. 1. Recre.aLlon Residents of the annexed area may ute all existing recreational f.irl)LtlPS, parks, etc. on the effective date of annexation. The same standards and policies now used iri the present city will be followed in expanding the recreational program and farilities in the enlarged city. M.
