AN ORDINANCE OF THE CITY COUNCIL, CITY OF COLLEGE STATION, TEXAS
PROPOSINGAND ORDERING A BOND ELECTION TO BE HELD ON DECEMBER 8,
1990; PROVIDING FOR NOTICE OF THE ELECTION AND THE MAILING OF
COPIES OF PROPOSED PROPOSITIONS TO QUALIFIED VOTERS WITHIN THE CITY
OF COLLEGE STATION; FIXING THE TIME, PLACE AND MANNER FOR HOLDING
THE ELECTION; ESTABLISHING POLLING PLACES, PROVIDING FOR ELECTION
JUDGES AND CLERKS THEREOF; AND, AUTHORIZING THE MAYOR TO SIGN AN
OFFICIAL ORDER OF ELECTION.
WHEREAS, the City Council of the City of College Station, Texas
(the "City"), deems it advisable to call the election hereinafter
ordered; and
WHEREAS, it is hereby officially found and determined that a case
of urgent public necessity exists which requires the holding of the
hereinafter called election on a date other than a uniform election
date established by Section 41.001(a), Texas Election Code;
Therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS, THAT
SECTION 1.
A special election shall be and the same is hereby ordered to be
held on the second Saturday in December, 1990, the same being
December 8th, which is not less than (15) nor more than (90) days
from the date of this ordinance, at which election there shall be
submitted to the duly qualified resident electors within the City,
for their action thereupon, the following propositions, to-wit:
PROPOSITION NO. 1
SMALL THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, BE
AUTHORIZED TO ISSUE BONDS OF SAID CITY, IN ONE OR MORE SERIES, IN
THE AGGREGATE PRINCIPAL AMOUNT OF $4,500,000, MATURING SERIALLY
WITHIN 30 YEARS FROM THEIR DATE OR DATES, AND BEING SOLD AT SUCH
PRICES, BEARING INTEREST AT A RATE OR MATES NOT TO EXCEED THE
MAXIMUM AUTHORIZED BY LAW AT THE TIME OR TIMES SUCH BONDS ARE
ISSUED, AND BEING SOLD AT SUCH PRICES, ALL AS SHALL BE DETERMINED
WITHIN THE DISCRETION OF THE CITY COUNCIL, FOR THE PURPOSE OF
MAKING PERMANENT PUBLIC IMPROVEMENTS, TO-WIT: STREET IMPROVEMENTS,
INCLUDING BUT NOT LIMITED TO, REHABILITATION OF COLLECTORS AND
THOROUGHFARES; SIDEWALKS; TRAFFIC SIGNAL ENHANCEMENT AND NEW STREET
CONSTRUCTION; AND SMALL THE CITY COUNCIL BE AUTHORIZED TO LEVY AND
CAUSE TO BE ASSESSED AND COLLECTED AD VALOREM TAXES ON ALL TAXABLE
PROPERTY IN THE CITY, IN AN AMOUNT SUFFICIENT TO PAY THE INTEREST
ON SAID BONDS AND PROVIDE A SINKING FUND TO PAY SAID BONDS AT
MATURITY?

MATE OR RATES NOT TO EXCEED THE MAXIMUM AUTHORIZED BY LAW AT THE
TIME OR TIMES SUCH BONDS ARE ISSUED, AND BEING SOLD AT SUCH PRICES,
ALL AS SMALL BE DETERMINED WITHIN THE DISCRETION OF THE CITY
COUNCIL, FOR THE PURPOSE OF MAKING PERMANENT PUBLIC IMPROVEMENTS,
TO-WIT: THE PARKLAND DEVELOPMENT OF WOLFPEN CREEK CORRIDOR; AND
SMALL THE CITY COUNCIL BE AUTHORIZED TO LEVY AND CAUSE TO BE
ASSESSED AND COLLECTED AD VALOREM TAXES ON ALL TAXABLE PROPERTY IN
THE CITY, IN AN AMOUNT SUFFICIENT TO PAY THE INTEREST ON SAID BONDS
AND PROVIDE A SINKING FUND TO PAY SAID BONDS AT MATURITY?
PROPOSITION NO. 3
SHALL THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, BE
AUTHORIZED TO ISSUE BONDS OF SAID CITY, IN ONE OR MORE SERIES, IN
THE AGGREGATE PRINCIPAL AMOUNT OF $1,000,000, MATURING SERIALLY
WITHIN 30 YEARS FROM THEIR DATE OR DATES, BEARING INTEREST AT A
MATE OR MATES NOT TO EXCEED THE MAXIMUM AUTHORIZED BY LAW AT THE
TIME OR TIMES SUCH BONDS ARE ISSUED, AND BEING SOLD AT SUCH PRICES,
ALL AS SMALL BE DETERMINED WITHIN THE DISCRETION OF THE CITY
COUNCIL, FOR THE PURPOSE OF MAKING PERMANENT PUBLIC IMPROVEMENTS,
TO-WIT: ACQUISITION OF ADDITIONAL LAND FOR THE EXPANSION OF
MUNICIPAL PARKS; AND SHALL THE CITY COUNCIL BE AUTHORIZED TO LEVY
AND CAUSE TO BE ASSESSED AND COLLECTED AD VALOREM TAXES ON ALL
TAXABLE PROPERTY IN THE CITY, IN AN AMOUNT SUFFICIENT TO PAY THE
INTEREST ON SAID BONDS AND PROVIDE A SINKING FUND TO PAY SAID BONDS
AT MATURITY?
PROPOSITION NO. 4
SHALL THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, BE
AUTHORIZED TO ISSUE BONDS OF SAID CITY, IN ONE OR MORE SERIES, IN
THE AGGREGATE PRINCIPAL AMOUNT OF $1,000,000, MATURING SERIALLY
WITHIN 30 YEARS FROM THEIR DATE OR DATES, BEARING INTEREST AT A
RATE OR MATES NOT TO EXCEED THE MAXIMUM AUTHORIZED BY LAW AT THE
TIME OR TIMES SUCH BONDS ARE ISSUED, AND BEING SOLD AT SUCH PRICES,
ALL AS SHALL BE DETERMINED WITHIN THE DISCRETION OF THE CITY
COUNCIL, FOR THE PURPOSE OF MAKING PERMANENT IMPROVEMENTS, TO-WIT:
IMPROVING THE EXISTING PUBLIC PARKS IN THE CITY AND CONSTRUCTION OF
ADDITIONAL PARKS IN THE CITY, AND SHALL THE CITY COUNCIL BE
AUTHORIZED TO LEVY AND CAUSE TO BE ASSESSED AND COLLECTED AD
VALOREM TAXES ON ALL TAXABLE PROPERTY IN THE CITY, IN AN AMOUNT

PROPOSITION NO. 5
SHALL THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, BE
AUTHORIZED TO ISSUE BONDS OF SAID CITY, IN ONE OR MORE SERIES, IN
THE AGGREGATE PRINCIPAL AMOUNT OF $2,500,000 MATURING SERIALLY
WITHIN 30 YEARS FROM THEIR DATE OR DATES, BEARING INTEREST AT A
RATE OR RATES NOT TO EXCEED THE MAXIMUM AUTHORIZED BY LAW AT THE
TIME OR TIMES SUCH BONDS ARE ISSUED, AND BEING SOLD AT SUCH PRICES,
ALL AS SHALL BE DETERMINED WITHIN THE DISCRETION OF THE CITY
COUNCIL, FOR THE PURPOSE OF MAKING PERMANENT PUBLIC IMPROVEMENTS,
TO-WIT: CONSTRUCTING A NEW MUNICIPAL LIBRARY AND PROVIDING BOOKS
AND EQUIPMENT THEREFOR; AND SHALL THE CITY COUNCIL BE AUTHORIZED TO
LEVY AND CAUSE TO BE ASSESSED AND COLLECTED AD VALOREM TAXES ON ALL
TAXABLE PROPERTY IN THE CITY, IN AN AMOUNT SUFFICIENT TO PAY THE
INTEREST ON SAID BONDS AND PROVIDE A SINKING FUND TO PAY SAID BONDS
AT MATURITY?
PROPOSITION NO. 6
SHALL THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, BE
AUTHORIZED TO ISSUE BONDS OF SAID CITY, IN ONE OR MORE SERIES, IN
THE AGGREGATE PRINCIPAL AMOUNT OF $300,000, MATURING SERIALLY
WITHIN 30 YEARS FROM THEIR DATE OR DATES, BEARING INTEREST AT A
RATE OR RATES NOT TO EXCEED THE MAXIMUM AUTHORIZED BY LAW AT THE
TIME OR TIMES SUCH BONDS ARE ISSUED, AND BEING SOLD AT SUCH PRICES,
ALL AS SHALL BE DETERMINED WITHIN THE DISCRETION OF THE CITY
COUNCIL, FOR THE PURPOSE OF MAKING PERMANENT PUBLIC IMPROVEMENTS,
TO-WIT: CONSTRUCTION OF PUBLIC BUILDINGS; AND SHALL THE CITY
COUNCIL BE AUTHORIZED TO LEVY AND CAUSE TO BE ASSESSED AND
COLLECTED AD VALOREM TAXES ON ALL TAXABLE PROPERTY IN THE CITY, IN
AN AMOUNT SUFFICIENT TO PAY THE INTEREST ON SAID BONDS AND PROVIDE
A SINKING FUND TO PAY SAID BONDS AT MATURITY?
PROPOSITION NO. 7
SHALL THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, BE
AUTHORIZED TO ISSUE BONDS OF SAID CITY, IN ONE OR MORE SERIES, IN
THE AGGREGATE PRINCIPAL AMOUNT OF $300,000, MATURING SERIALLY
WITHIN 30 YEARS FROM THEIR DATE OR DATES, BEARING INTEREST AT A
RATE OR RATES NOT TO EXCEED THE MAXIMUM AUTHORIZED BY LAW AT THE
TIME OR TIMES SUCH BONDS ARE ISSUED, AND BEING SOLD AT SUCH PRICES,
ALL AS SHALL BE DETERMINED WITHIN THE DISCRETION OF THE CITY
COUNCIL, FOR THE PURPOSE OF MAKING PERMANENT PUBLIC IMPROVEMENTS,
TO-WIT: AN EARLY WARNING WEATHER SYSTEM; AND SHALL THE CITY COUNCIL

BE AUTHORIZED TO LEVY AND CAUSE TO BE ASSESSED AND COLLECTED AD
VALOREM TAXES ON ALL TAXABLE PROPERTY IN THE CITY, IN AN AMOUNT
SUFFICIENT TO PAY THE INTEREST ON SAID BONDS AND PROVIDE A SINKING
FUND TO PAY SAID BONDS AT MATURITY?
PROPOSITION NO. 8
SHALL THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, BE
AUTHORIZED TO ISSUE BONDS OF SAID CITY, IN ONE OR MORE SERIES, IN
THE AGGREGATE PRINCIPAL AMOUNT OF $75,000 MATURING SERIALLY WITHIN
30 YEARS FROM THEIR DATE OR DATES, BEARING INTEREST AT A RATE OR
RATES NOT TO EXCEED THE MAXIMUM AUTHORIZED BY LAW AT THE TIME OR
TIMES SUCH BONDS ARE ISSUED, AND BEING SOLD AT SUCH PRICES, ALL AS
SHALL BE DETERMINED WITHIN THE DISCRETION OF THE CITY COUNCIL FOR
THE PURPOSE OF MAKING PERMANENT PUBLIC IMPROVEMENTS, TO-WIT:
REPAIRS AND IMPROVEMENTS OF THE CITY CEMETERY; AND SHALL THE CITY
COUNCIL BE AUTHORIZED TO LEVY AND CAUSE TO BE ASSESSED AND
COLLECTED AD VALOREM TAXES ON ALL TAXABLE PROPERTY IN THE CITY, IN
AN AMOUNT SUFFICIENT TO PAY THE INTEREST ON SAID BONDS AND PROVIDE
A SINKING FUND TO PAY SAID BONDS AT MATURITY?
PROPOSITION NO. 9
SHALL THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, BE
AUTHORIZED TO ISSUE BONDS OF SAID CITY, IN ONE OR MORE SERIES OR
ISSUES, IN THE AGGREGATE PRINCIPAL AMOUNT OF $3,000,000 MATURING
SERIALLY WITHIN 30 YEARS FROM THEIR DATE OR DATES, BEARING INTEREST
AT A RATE OR RATES NOT TO EXCEED THE MAXIMUM AUTHORIZED BY LAW AT
THE TIME OR TIMES SUCH BONDS ARE ISSUED, AND BEING SOLD AT SUCH
PRICES, ALL AS SHALL BE DETERMINED WITHIN THE DISCRETION OF THE
CITY COUNCIL, FOR THE PURPOSE OF MAKING PERMANENT PUBLIC
IMPROVEMENTS, TO-WIT: STREET IMPROVEMENTS RELATING TO THE LOTRAK
PROJECT ALONG WELLBORN ROAD WITHIN THE CITY LIMITS OF COLLEGE
STATION, INCLUDING RIGHT-OF-WAY ACQUISITION, RELOCATION OF EXISTING
UTILITIES AND LANDSCAPING; AND SHALL THE CITY COUNCIL BE AUTHORIZED
TO LEVY AND CAUSE TO BE ASSESSED AND COLLECTED AD VALOREM TAXES ON
ALL TAXABLE PROPERTY IN THE CITY, IN AN AMOUNT SUFFICIENT TO PAY
THE INTEREST ON SAID BONDS AND PROVIDE A SINKING FUND TO PAY SAID
BONDS AT MATURITY?
SECTION 2.
The polls shall be opened promptly at 7:00 a.m. and shall be closed
promptly at 7:00 p.m.

The election will be held at the following places and the election
officials shall be, for the purpose of this election, as follows=
Polllna Place Not 8, at South Knoll Elementary School with Sue
Melton as Presiding Judge and Miriam Moses as Alternate Judge; and
said Presiding Judge shall appoint no more than 4 clerks to assist
her.
Pollina Place No. 9, at College Station Conference Center on George
Hush Drive with Mary Schmidt as Presiding Judge and Marie Kelley as
Alternate Judge; and said Presiding Judge shall appoint no more
than 4 clerks to assist her.
Pollin~ Place No. 10, at College Station City Police Building
Complex with Audrey Bunting as Presiding Judge, and Ruby Freeman
as Alternate Judge; and said Presiding Judge shall appoint no more
than 4 clerks to assist her.
Pollin~ Place No. 24, at College Hills Elementary School with
Margie Wilkey as Presiding Judge, and Ramona McNeil as Alternate
Judge; and said Presiding Judge shall appoint no more than 4 clerks
to assist her.
Pollin~ Place No. 31, at A&M Consolidated High School with Vi Cook
as Presiding Judge, and Jean McDermott as Alternate Judge, and
said Presiding Judge shall appoint no more than 4 clerks to assist
her.
Pollin~ Place No. 3R, at College Station Fire Station No. 2 on Rio
Grande Drive with Kay Parker as Presiding Judge, and Mark Schulz as
Alternate Judge; and said Presiding Judge shall appoint no more
than 4 clerks to assist her.
Pollin~ Place No. 33, at Lincoln Center with Blossie Payton as
Presiding Judge, and Celestine Williams as Alternate Judge; and
said Presiding Judge shall appoint no more than 4 clerks to assist
her.
Pollin~ Place No. 34, at the College Station Central Fire Station
with Samille Stovall as Presiding Judge, and Charlotte Bergstad as
Alternate Judge; and said Presiding Judge shall appoint no more
than 4 clerks to assist her.
Pollin~ Place No. 35, consisting of county voting precincts No.
No. 21, and No. 35, at A&M Presbyterian Church, at 301 Church
Avenue, with Diana Smallwood as Presiding Judge, and David
Smallwood as Alternate Judge; and said Presiding Judge shall
appoint no more than 4 clerks to assist her.

Pollin~ Place No. 39, at the Tennis Center, Southwood Athletic
Park, with Jim Ward as Presiding Judge, and Ed Hoag as Alternate
Judge; and said Presiding Judge shall appoint no more than 4 clerks
to assist him.
Pollin~ Place No. 40, at the Aldersgate United Methodist Church,
with Dolly Olden as Presiding Judge, and Alta Olden as Alternate
Judge; and said Presiding Judge shall appoint no more than 4 clerks
to assist her.
SECTION 3.
Absentee voting shall be conducted by personal appearance and by
mail. Absentee voting by personal appearance shall be in the
Training Room at the City Hall, College Station, Texas; absentee
voting by mail shall end November 30, 1990. During the period
absentee voting is required or permitted by law, being November 19,
1990 through December 4, 1990, the hours designated for absentee
voting by personal appearance shall be from 8:00 A.M. to 5:00 P.M.
on each day except Saturdays, Sundays, and legal state holidays;
and the absentee voting clerk shall keep said absentee voting place
open during such hours for absentee voting by personal appearance.
The absentee voting clerk for said election shall be Connie Hooks.
SECTION 4
Punch card voting machines shall be used for voting at the
foregoing election precincts and electronic counting devices and
equipment shall be used for counting the ballots at said election.
Ballots for the election shall conform to the requirements of the
Texas Election Code, as amended, and shall have printed thereon the
following (abbreviated to the extent necessary, but a verbatim
statement of each proposition shall be displayed at each polling
place):

SECTION 5
The Council Room of the College Station City Hall, 1101 South Texas
Avenue, in said City, is hereby established at the Central Counting
Station to receive ballots for said election, the ballots to be
tabulated and returned to the office of the City Secretary.
The following persons are hereby appointed as the Absentee Ballot
Board to count the absentee ballots:

The Council Chambers of the College Station City Hall, 1101 South
Texas Avenue, is hereby established as the Central Counting Station
to receive ballots for said election, the ballots to be tabulated
and returned to the Office of the City Secretary of the City of
College Station.
The following persons are hereby authorized and approved as persons
employed and designated to handle the ballot, operate the
tabulating equipment, and count the ballots:

SECTION 6
A committee is hereby established consisting of the following
persons to hold Computer Accuracy Tests, including two tests prior
to the start and one test immediately after the count of the voted
ballots, to ascertain that the computer will accurately count the
votes cast for the propositions to be voted upon in said election=

SECTION 7
The Mayor of the City of College Station is hereby authorized to
sign an official NOTICE OF SPECIAL ELECTION as prescribed by the
Secretary of State of Texas; and a copy of the NOTICE OF SPECIAL
ELECTION shall be given by posting a copy thereof containing a
substantial copy of this ordinance at the City Hall and at three
other public places within said City not less than fourteen (14)
days prior to the date upon which said election is to be held, and
by publishing such notice on the same day in each of two successive
weeks in The Eagle, the first such publication to be not less than
ten (10) days prior to the date of said election. It is hereby
found and declared that The Eagle is a newspaper of general
circulation within said City.
SECTION 8
Ail resident qualified electors of the City shall be entitled to
vote at said election.

All election materials including notice of the electlon, ballots,
instruction cards, affidavits, and other forms which voters may be
required to sign and all absentee voting materials shall be printed
in both English and Spanish, or Spanish translations thereof,
and/or other assistance shall be provided, as required by the Texas
Election Code and the Federal Voting Rights Act of 1965, each as
amended.

An election is hereby ordered to be held on December 8, 1990 for
the purpose of determining whether said governing body shall be
authorized to issue bonds for capital improvements projects as
substantially contained in Ordinance No. 1863
Absentee voting by personal appearance will be conducted each
weekday at the College Station City Hall, 1101 South Texas
Avenue, College Station, Texas, between the hours of 8:00 a.m.
beginning on Monday, November 19, 1990, and ending on Tuesday
December 4, 1990.
Applications for ballot by mail shall be mailed to:

VISTO QUE, el Consejo de la Ciudad, Ciudad de College Station, Texas (la "C~udad"),
cons~dera aconsejable Ilamar la eleccion mas adelante ordenada; y
VISTO QUE, por esle medio ohcialmente encuentra y determina que un caso urgenle de
necesidad publica existe que requiere una elecc~on que se Ilevara acabo mas adelante en
una fecha d~st~nta a una fecha de elecc~on umforme establecida por Secc~on 41.001(a),

en otros ires lugares public, os denim de dicha C~udad no menos de catorce (14) d~as anles

Una eleccion esta mandado para el dia 8 de deciembre de 1990 para
determinar si la entidad goberuadora sea autonizada para sacar
lazos para el mejoramiento de los projectos capitales como
contienen en la ordenauza 1863.
La votacio en ausencia en persona se llevara a cabo de lunes a
viernes en la Palacio Municipal de la Ciudad de College Station,
1101 South Texas Avenue, College Station, Tejas entre las ocho
la manana y las cinco de la tarde empezando el 19 de november
1990 y terminando el 4 de december de 1990.
