HomeMy WebLinkAbout1988-1793 - Ordinance - 12/08/1988ORDINANCE NO. 1793 AN ORDINANCE CREATING SECTION 6 OF CHAPTER 10 OF THE CODE OF OR- DINANCES OF THE CITY OF COLLEGE STATION PERTAINING TO THE PARK- ING, STANDING, OR STORING OF RECREATIONAL VEHICLES, TRAILERS OR TRUCKS IN RESIDENTIAL AREAS OF THE CITY OF COLLEGE STATION. WHEREAS, on the 9th day of November, 1988, the City Council met and considered evidence concerning the parking, standing and storing of recreational vehicles, trailers and trucks in residen- tial areas; and WHEREAS, the City Council, after reviewing the possibility of provisions pertaining to the parking, storing and standing of recreational vehicles, trailers and trucks in residential areas, found that there should be regulations as to recreational vehi- cles, trailers and trucks in residential areas for the health, safety and welfare of the residents of the City of College Sta- tion; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION THAT: I. Chapter 10, Section 6 of the Code of Ordinances of the City of College Station is hereby created as follows: "A. DEFINITIONS 1. Camper - A separate vehicle designed for human habita- tion which can be attached and detached from a pick-up truck. 2. Driveway - Any paved, concrete, asphalt or other imper- vious surface area on a lot designed and required to provide direct access for vehicles between a street and private garage, carport, or other permitted parking space, or parking area or loading area, garage and at- tached or detached accessory building located on a lot developed with a residential dwelling used by the occu- pant of the premises principally for, but not limited to, the storage of passenger vehicles or other vehicles and equipment. 3. Front yard - shall mean the areas of a residential lot which are forward of the front building exterior wall. 4. Motor Home - A self-contained vehicle designed for hu- man habitation with its own motive power and with a passageway from the body of the home to the driver and front passenger seats. n05588 5. Motor Vehicle - A self-propelled device in, upon or by which any person or property is or may be transported. 6. Recreational Vehicle - Any motor vehicle or trailer de- signed or used as a travel trailer, camper, motor home, tent trailer, boat, boat trailer, camping trailer, or other similar purposes. 7. Residential area or residential lot - shall mean any area or lot occupied by residential dwellings though the area may be zoned for use other than residential. B. Side yard - shall mean the areas of a residential lot on either side of the dwelling which is between the front exterior wall and the rear exterior wall. 9. Trailer - A vehicle without motive power designed for carrying persons, animals, or property on its own structure and to be drawn by a vehicle with motive pow- er. The term shall include, but not be limited to, semi -trailer, utility trailer, and travel trailer. 10. Truck - A vehicle with motive power with greater than one -ton rated capacity. B. REGULATIONS 1. It shall be unlawful for the owner, occupant or person in charge of property used for residential purposes to permit the parking, standing or storing of trailers or trucks on residential streets for other than actual su- pervised loading or unloading of goods and passengers. It shall be unlawful for the owner, occupant or person in charge of property used for residential purposes to permit the parking, standing or storing of trailers or trucks in residential front yard drives for other than actual supervised loading or unloading of goods or pas- sengers. 2. It shall be unlawful for the owner, occupant or person in charge of property used for residential purposes to permit the parking, standing or storing of recreational vehicles on residential streets or residential front yard drives for a period of time in excess of seventy- two (72) hours within any thirty (30) day period. Ii. The penalties provision shall be the general penalty provided in Chapter 1, Section 5 of the Code of Ordinances of the City of College Station. - 2 - n05589 This ordinance shall become effective and be in full force and effect from and after its passage and approval by the City Council and duly attested by the Mayor and City Secretary.
