AN ORDINANCE VACATING AND ABANDONING A PORTION OF A THIRTY FOOT
WIDE ALLEY IN BLOCK 5 OF TAUBER ADDITION, BETWEEN CHURCH STREET
AND UNIVERSITY DRIVE, IN THE CITY OF COLLEGE STATION, TEXAS.
WHEREAS, the City of College Station, has received an Application
for the Abandonment of a portion of a thirty foot wide alley in
Block 5 of Tauber Addition, between Church Street and University
Drive, in the City of College Station, more particularly de-
scribed on Exhibits "A" and "B" attached hereto;
WHEREAS, on October 31, 1991, the City Council of the City of
College Station, Texas, heard the application of Eldred Keahey on
behalf of the Wesley Foundation for the vacation and abandonment
of a portion of the thirty foot wide alley in Block § of Tauber
Addition, between Church Street and University Drive, in the city
of College Station, as shown by plat recorded in Volume 133, Page
183 of the Official Records of Brazos County, Texas;
WHEREAS, on October 31, 1991, the City Council of the City of
College Station, Texas, determined that it would be in the best
interest of the citizens of the City of College Station to main-
tain a thirty foot wide utility easement in said alleyway;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
COLLEGE STATION, TEXAS, that a portion of the thirty foot wide
alley in Block 5 of Tauber Addition, between Church Street and
University Drive, in the city of College Station, Texas, more
particularly described in the attached Exhibits "A" and "B", be
abandoned and vacated; that the Mayor and City Secretary be
authorized to convey by quit claim deed on behalf of the City of
College Station any right or claim which the City has in and to
said strip of land to the Wesley Foundation, upon receipt of a
fully executed thirty foot wide public utility easement from the
Wesley Foundation to the City of College Station in said
abandoned alleyway.
PASSED, ADOPTED and APPROVED this 31st day of October, 1991.
