HomeMy WebLinkAbout1991-1914 - Ordinance - 09/26/1991ORDINANCE NO. 1914 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, AMENDING CHAPTER 3 OF THE CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION BY ADDING A NEW SUBSECTION F PERTAINING TO THE REQUIREMENT OF A PERMIT TO CUT THE PAVEMENT ON PUBLIC STREETS, SIDEWALKS AND ALLEYWAYS IN THE CITY OF COLLEGE STATION, TEXAS, AND BY RENUMBERING THE PRESENT SUBSECTIONS "F" AND "G" AS "G" AND WHEREAS, the City of College Station, Texas has approximately two hundred miles of street pavement that it must maintain; WHEREAS, the city of College Station, Texas has experienced dam- age to streets, sidewalks and alleyways caused by contractors and utilities in the installation and repair of underground facili- ties; WHEREAS, the city Council of the City of College Station, Texas desires to place the cost of street, alleyway and sidewalk repair on the parties that necessitate the repair rather than on the population as a whole; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, that Chapter 3 of the Code of Ordinances of the City of College Station, Texas, is hereby amended by adding a new Subsection F to read as set out below, and by renumbering the present Subsections "F" and "G" as "G" and "H": "F. PERMIT REOUIRED FOR STREET. SIDEWALK AND ALLEYWAY CUTS (1) No person shall cut or in anyway damage the streets, alleyways or sidewalks of the city of College Station for the installation of any materials and/or equipment without a permit. (2) A permit to cut a street, alleyway or sidewalk shall be applied for from the City Manager or his delegate. (3) Any person who applies for a permit shall pay the cost of the issuance of the permit, the repair of the street, sidewalk or alleyway and the cost of the in- spection of such repair, which fees shall be set by resolution from time to time. The city at its option may elect for the applicant to pay the estimated costs of repairs as a deposit prior to the issuance of the permit with said deposit not being less than the mini- mum payment set out by resolution. In the event that the cost exceeds the deposit the applicant shall remit the remainder of the cost to the City. In the event Ordinance No. 1914 Page 2 that the cost is less than the deposit, the overage shall be remitted to the applicant. (4) Any person who without a permit cuts or otherwise dam- ages a street, sidewalk or alleyway in the installation of any materials or equipment, or refuses to pay for repairs, shall be guilty of an offense punishable under this Code of ordinances. (6) Applicant may be authorized to make temporary or permanent repairs pursuant to City's specifications. If the permit authorizes the applicant to make repairs, then the applicant shall warrant the work for 365 days from the date of inspection and acceptance by City. Any person who fails to comply with the terms of this ordinance shall be guilty of an offense punishable under this Code of Ordinances. II. This ordinance shall become effective and be in full force and effect from and after its passage and approval by the city Coun- cil and duly attested by the Mayor and City Secretary.
